Marnier it is afTcnted, That all other, of what Eftate or -Condition they be, which have Bailiwicks or Hundreds in Fee, if they the fame wil! hold in their own Hands, then they fhall put in fuch Bailiffs for whom they will anfwer; (9) and if they will let the fame in Ferm to other, then they fhall let the fame at the ancient Ferm without any Thing increafing, as afore is faid. (10) And the Juftices of the one Bench and the other, the Barons of the Exchequer, and the Juftices affigned, fhaH have Power to inquire of all thofe that offend againft this Ordinance, at all Times that they come into the Country, and to exe- cute fuch Puniihrnent as to them fhall feem conve- nient to be done according to the Law and Reafon. (j 1 ) And if the Sheriffs or their Fermors be found in Default in any Point againft this Ordinance, and thereof be attainted, the Hundreds and Wapentakes where fuch Default fhall be found, fhall be taken in- to the King's Hands, and let to other by the fame Juftices, and to commit them to Prifon, there to re- main till they have made Fine and Ranfom to the King according to the Quantity of the Trefpafs ; and nevertheless they fhall anfwer to the King of the whole Ftrm. (12) And that the Lords which hold Hundreds or Wapentakes in Fee, fhall fet fuch Bai- liffs which be fufficient to anfwer the King and his People ; ( n) and if their Bailiffs do againft this Or- dinance, they fhall be called to anfwer ; (14) and if they be attainted, they fhall have fuch Punifhment as the Law of the Land requireth in fuch Cafe, and they fhall be out of their Bailiwicks for ever, and other fufficient put in their Places by the fame Lords.' CAP. X. Sheriffs -fhall have the keeping of Gaols. A Prifoner by Durefs becometh an Approver. Ex Rot. in Turr. TEM, in the Right of the Gaols, which were wont to be in ward of the Sheriffs, and annexed to their Bailiwicks ;" ' (2) it is affented and ac- corded, That they {hall be rejoined to the Sheriffs, and the Sheriffs fhall have the Cuftody of the fame Gaols, as before this Time they were wont to have ; (;) and that they fhall put in fuch Keepers for whom they will anfwer. (4) And if it happen that the Keeper of the Prifon, or Under-Keeper, by too great Durefs of Impnfonment, and by Pain, make any Prifoner that he hath in his Ward to become an Ap- pellor againft his Will, and thereof be attainted, he fhall have Judgement of Life and of Member. (5) And that the King's Juftices, before whom fuch Cafes fhall happen, fhall enquire the Truth thereof; (6) and if they find by Inqueft thereupon taken that any Keeper or Under Keeper hath done the fame, he fhall be thereof arraigned ; and if he be found guilty, he fhall have Judgement of Life and Member as afore is faid.'
