And if fuch Tenant be dead at the Time of the Judgement given upon fuch Writs of Attaint and of Error, that Reftitution of the faid Tenements be made to the Patty purfuing, with the Iffues after the Death of the faid Tenant, together with the Ar- rearages of the Rent, if any to him were due in the Life of the faid Tenant. ' II. Provided neverthelefs, that although the Te- Hem the Re- nant which fo did lofe by the firft Judgement be in verfion alleged! Life, and the Party purfuing will alledge that the ^VT^antwas fame Tenant was of Covin, and of Affent of the ^ covfn with" Demandant which recovered, that fuch Tenements the Demandant, ought to be loft, that Reftitution of the fame Tene- ments be made to the fame Party purfuing, with the Iffues and Arrearages, as afore is faid, Javing to fuch Tenant his Action by Writ of Scire facias, out of the fame Judgement fo reverfed or given, or Writ of Attaint, if he will traverfe the Covin and Affent aforefaid, and other wife not. And that this Statute The particular hold Place of Judgements to be given in Time to Tenants Reme- come, and alfo of two Judgements late given in d ^ '° traverfe the King's Bench in two Pleas of Error, the one *' Covln - betwixt Edmund Frances and Ideyn his Wife, Deman^- dants, and Robert Wejlby and other Tenants of cer- tain Tenements in Oxenford, and in the Suburbs of the fame Town ; and the other betwixt the faid Edmund and Ideyn Demandants, and Richard Cornwall and Ifabel his Wife and others Tenants, of certain Te- nements in the fame Town, of which Tenements the Reverfion at the Time of the faid two Judge- ments given did pertain to the Mafter and Scholars of the College of the Univerfity Hall in Oxenford, as it is faid, fo that the Mafter and Scholars may have and do their Suit by Writ of Attaint or of Error of the fame Judgements, as to them beft fhall feem, ac- cording to the Form of this Statute.
