- Revenge, have often caufed to be indidted and ap-
- pealed divers of our true liege People, of Treafons
- or Felonies in the County of Lancajlcr, pretending
- by thofe Appeals and Indictments, that the faid
- Treafons or felonies were committed in a certain
' Place, where of Truth no fuch Place is had in the ! faid County where the faid Appeal and lndidiment ' is made, to the great Damage and Peril of fuch our '" liege People, conlidering that fome Jo appealed and
- indicted dare not appear before the Juflices in their
- proper Perfons, to anfvver thereof, for Fear of beat-
- ing, maiming, or killing of them, by the Confpi-
- rators or Procurers of the fame Appeals and Indict-
' ments, as by the Commons of the Realm of England, ' in our laft Parliament holden at Wcftminjler, by their ' Petition there exhibited, grie'voufly complaining,
- was fhewed :" ' (2) It is ordained in the fame Par-
liament, by the Affent of the Prelates and Great Men of the fame Realm there being, at the Requeft of the faid Commons, for the common Profit and Qui- etnefs of the People of the fame Realm, That every Juftice which hath Po »ver to hear and determine fuch Treafons and Felonies within the faid County, by the Oath of Twelve Men (of whom every one fhall have Freehold in the fame County to the yearly Va- lue of an Hundred Shillings above all Charges) before that the Exigent be awarded, without Allegation of the Party, as well in the Party's Abfence as his Pre- fence, fhall inquire of Office, whether any fuch Place be in the County where fuch Appeals or In- dictments be made, or to be made, or not; (3) and if it be found that there is no fuch'Place within the fame County, then fuch Appeals and Indictments, and the Procefs thereupon made, or to be made, fhall be void, and holden for none ; and that in fuch Cafe the Indidtors aforefaid be punifhed by Imprifon- ment, Fine, and Ranfom by the Difcretion of the faid Juflices. (5.) And that .this prefent Ordinance and Remedy extend as well to Appeals and Indictments not determined before this Time, as to Appeals and In- dictments to be taken hereafter; (6) and if any Exi- gent from henceforth be awarded, before that fuch Inquifition of Office, as afore is faid, be taken, that the fame Exigent, and the awarding thereof, be like- wife void and holden for none.' Continued by 9 Hen. 5. c. 1. made perpetual 18 Hen. 6. c. 12. ' II. , Provided that this prefent Ordinance have Strength, and extend only until the next Parliament. (2) And alfo know ye, That in the faid Parliament, of the Affent and Requeft aforefaid, it was ordained and ltablifhcd, That in Writs to be purchafed againft thofe that forge or make untrue Charters or Miniments, and them proclaim, or.caufe to be read, like Procefs fhall be made by Capias and Exigent, a , in Writs of Trefpafs. (3) And therefore we command you, firmly injoining, That immediately after the Sight hereof, you caufe this Statute and Ordinance openly to be proclaimed in the Places within the fame County where fhall be mod ex-. pedientand neceffary, as well within Liberties as with- out ; (4) and that alfo you caufe all and fingular our Juftices, having Power to hear and determine Felo- nies and Treafons v/iihin the faid County, fully o 3 A.
