Vn. Provided always, and be it enacted, That where there are more Writings than one, for making and perfecting any Conveyance or Security, which do name, m.ention, or any Ways affect or concern the fame Flonors, Manors, Lands, Tenements or Plereditaments, it fhall be a fufficient Memorial and Regifter thereof, if all the faid Honours, Manors, Lands, Tenements and Hereditaments, and the Pa- rifhes, Tov/nfhips, Hamlets or Ertraparochial Places wherein the fame lie, be only once named or men- named but once tioned in the Memorial or Regifter of any one of the Deeds or Writings made for the perfecting of fuch in the Memo- Conveyance or Security ; and that the Dates of the reft of the faid Deeds or Writings relating to the faid Conveyance or Security, with the Names and Additions of the Parties, and WitnefTes, and the Places of their Abodes, be only fet down in the Memorials and Regi{ters of the fame, with a Reference to the Deed or Wrfting whereof the Memorial is fo regiftred, that contains or expreffes the Parcels mentioned in all the faid Deeds, and Diredions how to find the regiftring the fame. VIIL Provided alfo, and it is hereby enafted. That all Memorials of Wills that fliall be regi{lred in' Manner as aforefaid, within the fpace of fix Months after the Death of every refpeflive Devifor or Tefta- trix, dying within the Kingdom oi Great Britain, or within the Space of three Years after the Death of every refpeftive Devifor or Teftatrix, dying upon the Sea, or in any Parts beyond the Seas, fhall be as valid and effeftual againft fubfequent Purchafers, as if the fame had been regiftred immediately after the within GreatBri- Death of fuch refpedtive Devifor or Te{tatrix ; any thing herein contained to the contrary thereof in any tain, and 3Years vvife notwithftanding. jf beyond Sea. ^X Provided always. That in cafe the Devifee, or Perfon or Perfons interefted in the Honors, Manors, If the Devifee Lands, Tenements or Hereditaments, devifed by any fuch Will, as aforefaid, by Reafon of the Concealment, be difabled, the q^ Suppreffion, or contefting fuch Will, or other inevitable Difficulty, without his, her, or their wilful Ne- M^onthla'fterthe S'^*^ ^^^ Default, fliall be difabled to exhibit a Memorial for the Regiftry thereof within the refpedtive Times herein before limited, and that a Memorial fhall be entred in the faid Office of fuch Contefl, or other Impediment within the Space of two Years after the Death of fuch Devifor or Teftatrix, who fliall die with- in the Kingdom of Great Britain, or within the Space of four Yrars next after the Deceafe of fuch Perfon who fliall die upon the Sea, or beyond the Seas; then, and in fuch Cafe, the Regiftry of the Memorial of fuch Will, within the Space of fix Months next after his, her, or their Attainment of fuch Will, or a Probat thereof, or Removal of the Impediment whereby he, flie, or they are difabled or hindred to exhi- bit fuch Memorial, fhall be a fufficient Regiftry within the Meaning of this A£t ; any thing herein contained to the contrary thereof in any wife notwithftanding. X. Provided neverthelefs. That in cafe of any Concealment, or Suppreffion of any Will, orDevife, any Purchafer or Purchafers fhall not be difturbed, or defeated in his or their Purchafe, unlefs the Witt' be adtually regiftred within five Years after the Death of the Devifor or Teftatrix. XI. And be it further enafted. That every fuch Regifter or Mafter fhall be allowed for the Entry of every fuch Memorial, as is by this Adt diredted, the Sum of one Shilling, and no more, in cafe the fame do not exceed tv/o hundred Words ; but if fuch Memorial fhall exceed two hundred Words, then after the Rate and Proportion of fix Pence an Hundred for all the Words contained in fuch Memorial, ever and above the firft two hundred Words, and the like Fees for the like Number of Words contained itt every Certificate or Copy given out of the faid Office, and no more, and for every Search in the faid Of- fice, one Shilling and no more. XII. And be it further enadted by the Authority aforefaid, That every fuch Regifter or Mafter fhall due Attendance, gjyg due Attendance at his Office every Day in the Week (except Sundays and Holy-days) between the Hours of Nine and Twelve in the Forenoon, and the Hours of Two and Five in the Afternoon, for the Difpatch of all Bufinefs belonging to the faid Office ; and that every fuch Regifter or Mafter, as often as required, fnall make Searches concerning all Memorials that are regiftred, as aforefaid, and give Certifi- cates concerning the fame under his Hand (if required by ai;y Perfon) teftified by two credible WitnefTes. Xlil. And be it further enadted by the Authority aforefaid, That each of the faid Regifters or Mafters at the Time of his being fworn into the faid Office, as aforefaid, fhall enter into a Recognizance with two or more fufficient Sureties (to be approved of by the Lord Chancellor, or Lord Keeper, or LordS Commiifioners of the Great Seal of Great Britain, or the Chief Juftice of the ^eens Bench, Chief Juf- tice of the Conunon. Pleas, and Chief Baron of the Court of Exchequer, or any one of them) of the Pe- nalty of two thoufand Pounds unto her Majefty, her Fleir and Succeffors, to be taken by one of the faid Chief Juftices, conditioned for his true and faithful Performance of his Duty in the Execution of his faid Office, in all 1 hings diredted and required by this Adt ; the fame to be tranimitted by fuch Chief Juftice within one Month next after the Date thereof, into the Office of her Majefty's Remembrancer of the Exchequer, there to remain amongft the Records of the faid Court. XIV. And Difability re- moved rhall be fu fficient. Will concealed, &c. if not re- giftred in 5 Years after the Devifor's Death, fliall not defeat a Purchafe. Fees of the Re- giSler.
