' did firft put to Sea, although the faid Ships or Veffels do make Delivering Ports in Foreign Parts, whereby ' their Wages would othervvife come due by Law;' Be it therefore enafted by the Authority aforefaid, That no fuch Contrafts, nor any other private Contracts or Agreements, made or entred into by any Seaman or Mariner, fnall extend, or be conftrued to extend, in any Ways to debar, obftru£l, or delay the Payment of the Duties aforefaid, which by this or any other Ail are appropriated to the Ufe of the faid Hofpital. VII. And be it further enafted by the Authority aforefaid. That this Aft, and every Part thereof, fhall APublkk Aft, be taken and deemed to be a Publick Aft ; and if, at any Time or Times hereafter, any Perfon or Per- fons fhall be fued for any Matter or 1 hing done in the Execution of this Aft, fuch Perfon or Perfons fhall and may plead the General Iffue, and give this Aft and the Special Matter in Evidence ; and if upon Trial General Iffue. the Plaintiff fhall become nonfuited, or a Verdift fhall pafs for the Defendant, the Defendant fhall reco- ver Treble Cofts of Suit. VIII. Provided always, That nothing in this Aft do extend to oblige the Payment of the fix Pence per Nor to extend to Men/em, by any Mafters, Servants, or Apprentices of the Hoys, Smacks, or other Veffels belonging to Hoys, &c. em- ihe Port of London, and employed within the North Foreland, in bringing Corn, Fifh, or other Provifions f^^^cor'n p'/ft^* for the faid Port of London, during the Time they fliall be fo employed ; any thing in this Aft contained to &c. to London. the contrary notwithftanding. That after the Sale or Sales of fuch Prize or Prizes ' as fliall be taken from the Enemy, Publick Notification fliould be given by the Perfons or Agents ap-.
