and Town-council fliould think fit to prefcribe and order; excepting only from the faid Act all fuch Ale and Beer as mould be brewed in the Country without the Liberties of the Burgh by Heretors on their own Lands, and brought in by them (they inhabiting for the Time within the Town) to be confumed for the Ufe of themfelves and their Families only; and alfo excepting all Ale and Beer vended within the Precincts of Holy-Rood Houfe and Caftle of Edinburgh from the faid Impofition : And whereas fince the Union of the two Kingdoms there hath been a gradual Decreafe of the Revenue of the faid Town,., and there are feveral publick Works (which of late Years have been much neglected) neceffary to be carried on and done for the Service of the faid Town, which will coft a very confiderable Sum of Mo- ney, and the faid Town is much in Debt (Part of which was occafioned by the late Rebellion) and the faid Debt will, at the Expiration of the faid Act, be fo much increafed, that the Money arifing by the raid Impofition will fall very fhort of discharging of the fame : And whereas it is neceffary to enlarge the Harbour of Leitb and deepen the Channel thereof, and alfo to build and endow two new Churches, and make Proviiion for the Poor of the faid Town, which are now become very numerous :' Wherefore, your Majefty's molt dutiful and loyal Subjects, the Provoft, Magistrates and Council of the City of Edin- burgh, in Behalf of themfelves and the Community of the faid City do moft humbly befeech your Maje- fty, that it may be enacted : And be it enacted by the King's molt Excellent Majefty, by and with the burgh, in Behalf of themfelves and the Community of the faid Lity do moft humbly befeech your Maje- T'ne Rates and Jl„ -u„» :„ i__ n _ .1 . a ._ j i__ :,. n.„j u.. «.!.« V. >„ a. Effect to all Intents and Purpofes, for raifing, collecting, fecuring, difpofing, accounting for and levying the fame, during the faid Term of nineteen Years, as fully as if the fame were particularly and at large repeated and re-enacted in the Body of this prefent Act. ' II. And whereas by the faid in Part recited Act of the Parliament of Scotland, two -of the Lords of. ' Seffion, with two of the Parliament-men for the Shires of Edinburgh and Haddingtown, were to overlook Ovcifeers ap- ' and controul the Management of the Monies arifing by the faid Act :' Now for the better attaining the pointed to over- E nf j s hereafter mentioned, Be it further enacted, That the Lords of Seffion fhall, and they are hereby troulthe Monies authorized to nominate and appoint two of their own number, and the Barons of the Exchequer one of arifing by this their Number, the Sheriffs of the Shires of Edinburgh, Linlithgovj, and Haddingtciun are hereby authorized A&, and required to fummon the Heretors and Freeholders of the refpective Shires to meet annually, to the End that each Shire may elect and choofe two of their Number; the firft of which Elections by the Lords of Seffion, Barons of Exchequer, and by the Heretors and Freeholders of the Shires of Edinburgh, Lin- lithgow, and Haddingtoivn, fhall be made on the firft Tuefday of November one thoufand feven hundred and feventeen, and annually on the fecond Tuefday of June thereafter; and the Perfons fo elected and chofen, together with the Reprefentatives in Parliament for the Time being for the faid Shires of Edinburgh, Lin- lithgow, and Haddingtown, are hereby impowered and authorized to overlook and controul the Manage- ment of the Monies to arife by this A£t, to aid and concur in the feveral Cafes after-mentioned : And in. cafe they fhall find anv Mifmanagement or Mifapplication of the Monies arifing or to arife by this Act, or Vfho may profe- any other Abufe or Mifmanagement of or concerning the fame, they the faid Overfeers, or any two or cut= any Pc.-fons m0 re of them, may fue and profecute the Magiftrates or others concerned in the Abufe or Mifmanagement tor Mismanage- c QX R e( j re f s an j Reparation, in the Terms and under the Penalties contained in the aforefaid Act of the men Parliament of Scotland; and the firft Meeting of the faid Overfeers (if not fooner called together at the thecal] I meet R ec l ue ft °f the Magiftrates of Edinburgh) fhall be at the Town Council-chamber at Edinburgh, upon the ' y _ ' fecond Tuefday of November one thoufand feven hundred and feventeen, and they fhall have Power to ad-. adjourn them. j°urn themfelves from Time to Time; and one anniverfary Meeting fhall be had upon the third Tuefday of rdves.
