And it is hereby alio enacted and declared by the Authority aforefaid, That all the Monies be kept apart which fhall or ought to be fo Separated and kept apart for the faid Purpofes in this Act expreffed, fhall be and appropriated an( ] are hereby appropriated, and fhall from Time to Time be ifTued and applied to and for the Payment e. an( j Satisfaction of fuch Sum and Sums of Money as, according to the Tenor and true Meaning of this Act, fhall from Time to Time be due or payable to the faid Governor and Company of Merchants of Great Britain*, or their SuCceffors (fubject neverthelefs to fiich Reduction and Redemption, as are in and by this Ait: prefcribed touching the fame) and to noire other Ufe, Intent or Purpofe whatfoever; and that Penalty on of- the refpective Officers in the Exchequer, who fhaU make any wilful Delay in ifluing or paying the fime, thTuef th -r Ex " or ^ a ^ be guilty of diverting or misapplying any of the faid Monies contrary to this Act, for any fuch pivino the' aP " Offence fhall be forejudged of their refpective Offices or Places, and be rendred incapable to ferve his Money. Majefty, his Heirs or Succeffors, in any Office or Imployment of Truft or Profit whatfoever, and fhall alfo be liable to pay double the Value of any Sum or Sums of Money fo wilfully delayed to be paid, or fo diverted or mifapplied as aforefaid, to the laid Governor and Company of Merchants of Great Britain, and their Succeffors, to be recovered by Action of Debt or on the Cafe; Bill; Suit or Information in any of his Majefty's Courts of Record in Wejlininjler, wherein no Effoin, Protection, Wager of Law, or more than one Imparlance fhall be granted or allowed. Orders to be XXXIX. And for the better and more regular Payment of all the Monies intended by this Act to be figged by me p a;<^ t the faid Governor and Company of Merchants of Great Britain, and their Succeffors, at the diffe- makingPay- rent Rates and in fuch manner as aforefaid (fubject neverthelefs to fuch Reduction and Redemption as are ments to the by this Act provided concerning the fame) an Order or Orders fhall from Time to Time be made forth and Company. ftgned by the Commiffioners of the Treafury, or any three or more of them; or by the High Treafurer for the Time being; and after figning thereof the fame fhall be good, firm, valid and effectual in the Law; according to the Purport and true Meaning thereof and of this Act, and fhall not be determinable by or upon the Death or Removal of any Commiffioner or Commiffioners of the Treafury, or High Treafurer for the Time being, or by or upon the Death or Determination of the Power, Office or Offices of them or any of them; nor fhall any Commiffioners of the Treafury, High Treafurer or Under Treafurer for the Time being have Power to revoke, countermand or make void fuch Order or Orders fo made forth and figned as aforefaid. Weekly Iffues XL. And for the more fpeedy Payment of the Monies which fhall be due and payable to the fame tu;fce made at Governor and Company, or their Succeffors thereupon; It is hereby further enacted and declared by the the Exchequer. Authority aforefaid, That weekly or otherwife, as the Monies appointed or intended by this Act to be applied for or towards the faid Payments to grow due to them as aforefaid; lhall from Time to Time be brought into the Receipt of the Exchequer, and fhall or ought to be fet apart for that Purpofe as afore- faid, fuch Monies fhall and may, from Time to Time, be iffued upon fuch Order or Orders for or towards difcharging the faid Annuity or yearly Fund of the fame Governor and Company, and the faid Additions to be made thereunto; and for or towards the Payment of the faid yearly Sum of nine thoufand three hundred ninety-feven Pounds nine Shillings and fix Pence; and the faid further Allowances for Charges of Management to grow due at the End of that Quarter of a Year in which fuch Iiiues or Pay- ments fhail be made; fo as fuch weekly or other Payments do not exceed the Sums which fhall grow due for or at the End of fuch Quarter refpectively. beflciency to be XLI; And be it further enacted by the Authority aforefaid; That if at any Time or Times the Monies mad.- good out wn ich fhall be brought into the Exchequer, and be fet apart as aforefaid, for making the Payments by this ? f the ° u v " e p ' us Act appointed and intended to be made to the faid Governor and Company of Merchants of Great Britain^ mCenr. Quarter, and their Succeflbrs as aforefaid (which Monies are by this Act appropriated for or towards that Ufe and Purpofe) fhall not be fufficient to pay and difcharge or compleat the Payment at the End of any Quarter of a Year of all' the Monies which fhall he then due for or upon their faid prefent Annuity or yearly Fund; arid the faid Additions' to be made thereunto, and for or upon the faid yearly Sum of nine thoufand three hundred ninety-feven Pounds nine Shillings and fix Pence for Charges of Management, and the Addi- tions to be made to the fame as aforefaid; then and fo often and in every fuch Cafe, the Deficiency of any fuch Quarter fhall and may be fupplied out of the Overplus Monies to arife and to be fet apart as afore- faid in any fubfequcnt Quarter. Annuities not XLII.
