Which feveral and refpedtive Allowances, or Sums of Money for each Species before mentioned, By whom the fliall be paid and anfwered by the Cuftomer or Collector of the Cuftoms, with the Privity of the Con- Allowances Hull trailer of the Port, from whence the fame fhall be exported, on a Debenture to be made forth by the e pal ' Cuftomer or Collector, according to the Entry of the Goods, and the Shipping thereof verified by the Searcher, and Oath made by the Exporter on the Entry or Debenture, before the Cuftomer or Collector, or Controller of fuch Port, that the faid Goods are of Britijb Manufacture, and expoited or intended to be exported to Parts beyond the Seas, and not relanded or intended to be relanded in any Part of Great Britain', the Exporter, with one or more Perfon or Perfons, firft giving fufficient Security to the faid . Goods as fliall be entred for or landed in any of his Majefty's Plantations in America, which refpedtive Certificates for fuch Silks, Stuffs, or other Manufactures aforefaid, as fliall be landed in any Port or Placa where any Officer or Officers of his Majefty's Cuftoms fhall be reftdent, fliall b; figned by the proper Officer or Officers of his Majefty's Cuftoms there, importing that fuch Go6ds were there landed, teftifying the landing thereof; and for fuch Silk, Stuffs, and other Manufactures aforefaid, as fliall be entred for the Iflands of Jerfey, Guernfey, Alderney or Sark, fhall be figned by the proper Officer or Offi- cers of his Majefty's Cuftoms, if any. fuch Officer or Officers fliall be rending in tiiofe Iflands respective- ly,- and for want of fuch Officer refiding there, then by the Governor of thofe Iflands, or the Deputy- Governor thereof refpectively ; and for fuch Silk, Stuffs, or other Manufactures aforefaid, as fhall be fo entred for any other foreig'n Port or Place, to bring a Certificate under the Common Seal of the chief Magistrate in luch Port or Place, or under the Hands and Seals of two known Britijb Merchants then being at fuch Port or Place that fuch Silks, or other Manufactures, were there landed ; or fuch Bond or Bonds fhall be difcharged upon Proof in either of the faid Cafes, that fuch Goods were taken by Ene- mies, or periflied in the Seas', the Examination and Proof thereof being left to the Judgment of the Commiffioners of the Cuftoms in England or Scotland refpectively for the Time being. II. And for the better preventing Frauds in the entering any of the faid Goods under a wrong De- Searcher, &c. aft nomination, to the Prejudice of the Revenue, Be it further enacted by the Authority aforefaid, That ter . '""" it fhall and may be lawful to and for- any Searcher, or other proper Officer of the Cuftoms, after the amine a es > &CJ Entry of any of the faid Goods, and before or after the Shipping thereof, to open and ftridtly examine any Bale, Trufs, Cheft, or other Package, as now by Law they may do, to fee if the Goods are right entered ; and if on fuch 'Examination the fame fhall be found to b; right entered, the Officer fhall at his own Charge caufe the fame to be repacked, to the Satisfaction of the Exporter, which Charge fhall be allowed to the faid Officer by the Commiffioners of the Cuftoms, if they think it reafonable ; but in cafe the faid Officer fhall find the faid Goods, or any Part thereof, to have been entered under a wrong De- nomination, whereby his Majefty would have been defrauded in the Allowance to be paid on the Expor- tation of fuch Goods, contrary to the true Intent and Meaning of this Act, all fuch Goods fo wrong Goods wrong entered fhall and'may be feifed, and the fame, as likewife the Value thereof, fhall be forfeited and loft, ent ered, forfeited and fhall and may be profecuted and' divided as herein after mentioned.
