And whereas Doubts have arifen and been made of and concerning the feizing of fuch Bran- and b > ' whom ' dy, Arrack, Rum, Spirits and Strong Waters, as well Foreign as Britijh, and alfo of fuch Foreign to e ma e. 4 excifeable Liquor, as by Act or Acts relating thereto now in Force, are in feveral and refpective Cafes f enacted and declared to be forfeited ; now to clear all Doubt and Queition therein, or relating thereto,' Be it enacted and declared by the Authority aforefaid, Thit the Liquors aforefaid, every or any of them, which have been, are, is, or hereafter fhall be. forfeited by any Act or Acts of Parliament pow in Force; or hereafter to be made, together with the Casks, Bottles, VefTels, or other Package containing the fame, ought to be, and from time to time fhall and may be feized by any Officer or Officers of the Cu- ifoms or Excife respectively, or by fuch Perfon or Perfons who are or fhall be deputed or authorized there- to, by.Warrant from the Lord Treafurer or Under Treafurer, or by Special Commiffion from his Ma- jefly, under the Great Seal or Privy Seal, but by none other or others whatfoever. «r« fift &f ( f" 5 " XXV. And be it further enacted by the Authority aforefaid, That if any Action or Suit fhall be com- menced againft any Perfon or Perfons for any Thing done in Purfuance of this Act, that the Defendant or Defendants in fuch Action or Suit may plead the General IfTue, and give this Act and the Special Mat- ter in Evidence, at any Trial to be had thereupon, and that the fame was done in Purfuance and by the Authority of the faid Act ; and if it fhall appear fo to have been done, then the Jury fhall find for the Defendant or Defendants ; and if the Plaintiff fhall be nonfuited, or difcontinue his Action, after the Defendant or Defendants fhall have appeared, or if Judgment fhall be given upon any Verdict or De- Treble Cofts. murrer againft the Plaintiff,, the Defendant or Defendants fnall and may recover treble Cofts, and have the like Remedy for the fame, as the Defendant or Defendants hath or have in other Cafes by Law. ^ h,s *f f to t XXVII.
