' thereof, and will be much more ufeful and beneficial, if the Bonds given or entred into by the Contri- ' butors as aforefaid, could be made a real Charge upon fuch Houfes or Buildings for which fuch Contribution ' was made, without taking InfeofFment, the Expence whereof will in many Cafes exceed the Sum men- Claufe for fecu- ' tioned in fuch Bond :' Now for promoting and encouraging fo good and charitable a Defign, Be it fur- ring thePayment ther enacted by the Authority aforefaid, That from and after the fifth Day of June one thoufand {even °J Monc >' con " hundred and twenty-eight it (hall and may be lawful fo and for the Managers or Directors of the faid Ge- ■"charitiUeFund nera ' charitable Fund or Stock for the Time being, and their SuccefTors in Office, to take and receive from forReliefof Suf- fuch Perfon and Perfons as hath or have figned, or entred into the Articles or Covenants for contributing, ferersbyFite at or fhall hereafter fign or enter into Articles or Covenants to contribute to the faid General Fund or Stock, Edinburgh, a Bond or Bonds, carrying Intereft payable to fuch Perfon as is or fhall be appointed Cafliier to the faid Contributors for the Time being, and his SuccefTors in the faid Office, for fuch Sum or Sums of Money as hath, have or fhall be contributed by fuch Perfon or Perfons as hath, have or mall fign fuch Articles or Co- venants for the faid General charitable Fund for the Purpofes aforefaid ; and the faid Cafhier for the Time being, and his SuccefTors in Office fhall, and he is hereby required with all convenient Speed to carry, de- liver or tender, or caufe to be carried, tendred or delivered fuch Bond and Bonds fo given as aforefaid, to the Office kept by the Clerk, or Keeper of the RegilTer for Seizins within and for the faid City of Edin- burgh ; and the faid Clerk and Keeper of the faid Regifter is hereby directed and required to regifter fuch Bond and Bonds, and to deliver back the fame duly regiftred within twenty-four Hours after fuch Bond or Bonds is and are offered at fuch Regifter-Office, with a Certificate upon the Back of each Bond fo tendred or delivered, duly figned by the Clerk or Keeper of fuch Regifter, mentioning the Day and Time of the Day fuch Bond fhall be regiftred, and alfo the Book and Page or Pages of fuch Book wherein fuch Bond or Bonds is or are regiftred or recorded ; and fuch Clerk or Keeper fhall and may demand for regiftring of each Bond, and writing and figning the Certificate thereof, the Sum of one Shilling Sterling and no more ; and that fuch Sum and Sums of Money due or to grow due upon fuch Bond or Bonds fhall, from and after the Day and Time the fame fhall be fo regiftred and certified, be and the fame is and are hereby declared and enacted to be -a. real Charge and Incumbrance upon fuch Houfe, Tenement, Houfes or Tenements, Building or Buildings, for or or in Confideration whereof fuch Bond or Bonds was or were given or entred into ; and that in all Cafes where there fhall happen to be any Difpute between Creditors or other Claim- ants, fuch Bond and Bonds fhall be clafled, ranked and preferred according to the Day and Time of the Day the fame was or were regiftred, and fhall be, and the fame are hereby declared to be of the fame Va- lidity, Force and Effect, as if formal InfeofFments had been taken on fuch Bond and Bonds of the Date of which the fame fhall refpectively be regiftred ; any Law, Statute, Cuftom or Ufage to the contrary thereof notwithftanding. CAP. XXIII. An Act for indemnifying Perfons who have omitted to qualify themfelves for Offices and Im- ployments within the Time limited by Law, and for allowing further Time for that Purpofe j and for repealing fo much of two Acts of Parliament therein mentioned as requires Perfons. to qualify themfelves to continue in Offices or Imployments for the Space of fix Months, after the Demife of his Majefty, his Heirs or SuccefTors. 4 ' Perfons who have omitted to qualify themfelves, taking the Oaths, &C. before 28 'Nov: 1728, indemnified, " Perfons who have qualified themfelves fince 11 June 1727, alfo indemnified. Not to extend to Offices " actually avoided or filled up. Officers in Scotland taking the Oaths at JVeJlminfter, to tranfmit within " three Months a Certificate thereof to Scotland.
