An Aft to make an Aft of the tenth Year of her late Majefty, Intituled, An Aft for regw lating, improving and encouraging of the Woollen Manufacture of mixt or medley Broad-Cloth, and for the better Payment of the Poor imployed therein, more effectual for the Benefit of Trade in general ; and alfo to render more effeftual an Aft of the feventh Year of her faid Ma- jelly's Reign, intituled, An Atl for the better ascertaining the Lengths and Breadths of Wool- len Cloth made in the County of York. ' '■ YJC/"HF,'REAS an.AS paffed in the tenth Y«ar of her late Majefty's Reign, intituled, An M for VV regulating, improving and encouraging the Woollen ManufaSture of mixt or medley Broad-Cloth, and ' for the better Payment of the Poor imployed therein, hath proved ineffectual to prevent the Abufes committed ' in making and measuring the faid Cloth, to the great Difreputation of the faid Manufacture abroad 3nd •* Difcouragement of the good Makers and fair Dealers therein ;' For Remedy whereof, Be it enacted by the King's inoft Excellent Majefty, by and with the Advice and Confent of the Lords. Spiritual and Tem- poral and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the twentieth Day of September one thoufand feven hundred and fifteen, all mixt or medley Broad- Cloih fhall at the Inuance and Requeft of any Buyer, for Proof thereof, be put into Water, (as by ancient Cuftom they ufually were) and then meafured by any two indifferent Perfons to be appointed and chofen c. 7. left or refufe, within the Space of two Hours, to chufe or nominate fuch third Perfon, or if fuch third Perfon fo chofen fhall neglect or refufe to take upon him the Admeafurement of the faid Cloth, at the Requeft of the Seller or Buyer thereof, then fuch Adm:afurement (if in London) finally fhall be made and determined by the Keeper of Blackivcll-Hall, who fhall be fworn before fome Juftice of the Peace (which Juftice is hereby impowered to adminifter fuch Oath) That he will well and truly perform fuch Meafurin? and be obliged to adt for that Purpofe, and the Admeafurement fo made fhall be conclusive on all Parties and accordingly be the Rule of Payment to the Buyer ; and if elfewhere than in London, the faid Cloth fhaH be meafured by any two indifferent Perfons, as aforefaid, and in cafe they difagree therein, or refufe to make fuch Admeafurement, or neglect or refufe to appoint a third Perfon for fuch Admeafurement as aforefaid, then a fit Perfon fhall be nominated and appointed by the Chief Magiftrate or Chief Officer of fuch City, Town or Place, where the faid Cloth fhall happen to be fold, which faid Magiilrate or Chief Officer, as aforefaid, is hereby authorized and required to appoint and fwear fuch Perfon, which Perfon fo appointed fhall be and is hereby obliged to be fworn, and to act for the Purpofe aforefaid, which faid Perfon or Perfons determining the Meafure of the find Cloth fhall have and receive fix Pence, and no more for each Piece of Cloth which fhall be by him or them fo meafured, to be paid by the Buyer of the' faid Forfeiture for a Cloth; and if upon fuch Admeafurement, as aforefaid, there fhall be found a leis or fmaller Content or mentioned in the Seal To be paid by the fixth Part of the Value of every fuch Cloth, to the Ufes as is afterwards herein provided for by this Act ; and the faid Foifeiture fhall be paid by the Buyer, and by him deducted out of the Price of the faid authorized and required to adminifter, and thereof to give the faid Perfon or Perfons a Certificate without To be repaid by Fee or Reward ; and all fuch Sums of Money which the Clothier, Owner or Seller of any fuch Clo:h '•jeM after, &c. fhall forfeit and pay upon account of fuch fraudulent Seal of the Mafter, Occupier or Millman of the mm" who'fixed Fulling-Mill, being fixed to the faid Cloth, fhall upon Demand be repaid by the faid Mafter, Occupier or the Seal. Millman of the Fulling-Mill, who affixed the (aid Seal, to fuch Clothier, Owner or Seller of fuch Cloth • any Thing to the contrary notwithftanding. Miftcr of a Ful- II.
