D. 737 nures, Terms, Claims and Demands whatfoever, of what Nature, Kind, or Quality foever, of, in, to or out of the faid Manors, Offices, Meffuages, Parks, Lands, Tithes, Tenements or Hereditaments or any of them, Parcel of or annexed to the faid Duchy of Cornwall, as they or any of them had ought to have had before the making of this Act, to all Intents and Purpofes, and in as large and ampl Manner and Form, as if this Act had never been made ; this Act or any thing herein contained to th contrary notwithftanding. CAP. XXX. An A£l for repealing the Duties payable ad Valorem, upon Foreign Oyfters imported into thi: Kingdom, and for laying another Duty thereon. Moft Gracious Sovereign, Preamble. <■ "IT7HEREAS the feveral Duties upon Oyfters imported into this Kingdom, are now payable ' W according to the Value fworn to or affirmed by the Importers, which Method of afcertaining
- the Value of fuch Oyfters by Experience has been found to be liable to great Frauds, fuch Importers
' frequently undervaluing the Oyfters fo imported, to the Detriment of the Publick Revenue and Dif-
- couragement of the Oyfter Dredgers of this Kingdom ;' For remedying the faid Abufe, as well as err
couraging our own Fifhery, we your Majefty's moft dutiful and loyal Subjects the Commons of Great Britain, in Parliament affembled, do moft humbly befeech your Majefty that it maybe enacted, and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confer.t of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of Former Arts the fame, That all Provifions and Ciaufes contained in any former Act or Acis of Parliament, fo far as relating to the they relate to the afcertaining the Value of Oyfters imported from France according to the Oaths or Af- Oyfters repeal- 1 nnnat io ns of the Importers, ftwll from and after the twenty-fourth Day cf June one thoufand feven hundred and thirty feven be and are hereby repealed and made void. II. And be it further enacted by the Authority aforefaid, That in lieu of the faid former Duties pay- ed. French Oyfters Bulhel. rated at 7 d. per 2 °l e a ^ Valorem, and repealed by this Act, all Oyfters which (hall at any Time or Times after the faid twenty-fourth Day of June one thoufand feven hundred and thirty-feven, be imported from France into any Port or Place within this Kingdom, (hall upon the Importation thereof be rated at feven Pence per Bulhel ftrike Meafure, according to the Winchejhr Corn Bulhel, and fhall pay the old Subfidy granted by the Act of Tonnage and Poundage made in the twelfth Year of the Reign of King Charles the Second, according to that Rate and Meafure, and not according to the Values fworn to, or affirmed by the Importers, and in that Proportion for a greater or lefs Quantity. III. And be it further enacted by the Authority aforefaid, That in all Cafes where any of the faid Oyfters are by Law fubject or liable to the Payment of the further Subiidy, the one third Subfidy, the two thirds Subfidy, the additional Impoft, or the Duty payable upon Goods imported from France, or any of them, according to the refpective Values fet thereon for the faid Old Subfidy, or in Proportion thereto, the fame (hall from and after the faid twenty-fourth Day of June one thoufand feven hundred and thirty-feven, be paid propottionably according to the particular Value fet thereon for the Old Sub- fidy aforefaid, and not according to the Oath or Affirmation of the Importer ; any thing in the refpective Acts, which granted the faid Duties, or in any other Act to the contrary notwith- ftanding. IV. And be it declared and enacted by the Authority aforefaid, That upon the Exportation of any of • the faid Oyfters fo imported, within the Time allowed by Law, the Dut.es paid or fecured for the fame at Importation as aforefaid, fhall not be drawn back or allowed to the Exporter. V. And be it enacted and declared by the Authority aforefaid, That the feveral Subfidies, Impofitions, and Duties upon the faid Oyfters, fhall be paid or fecured, and fhall be raifed, levied, and collected in fuch Manner and Form, and by fuch Ways and Means, and under fuch Penalties and Forfeitures, and with fuch Difcounts and Allowances, as are mentioned and expreffed in the feveral Acts of Parliament which granted or continued the fame refpectively ; and all Powers, Penalties, Provifions, Articles and Ciaufes therein contained (except in fuch Cafes where any Alteration is made by this Act) lhall continue in full Force and Effect, during the Continuance of the faid refpective Subfidies, Impofitions, and other Duties, and lhall be applied, practifed and executed, for the raifing, levying, collecting, fecuring, an- fwering, paying, and appropriating the faid refpective Subfidies, Impofitions, and other Duties, accord- ing to the true Intent and Meaning of this prefent Act, as fully and effectually to all Intents andPur- £>oles, as if the faid Ciaufes, Matters and Tilings had been repeated and enacted in the Body of this prefent Act ; any Law or other Matter or Thing to the contrary notwithftanding. CAP. XXXI. An A<9: for regulating the Company of Watermen, Wherrymen and Lightermen rowing on the River 'Thames, between Grave/end in the County of Kent, and fVindfor in the County of Berks. all Old Subfidy, &c. to be paid according to the Rate. No Drawback on Exportation Duties how to fee levied.
