Informations XVIII. And be it further enacted, That all Actions, Suits and Informations, to be had and com and Anions menced up0 n this, or any other Acts for preventing the Exportation of Wooll, Wooll-fells, Wooll r"r',T e an°i morel nocks, Mortlings, Shortlings, Worfted, Bay or Woollen Yarn, Cruels, or Wooll nightly manufac cuted, tured, or MattrafTes, or Beds ftuffed with combed Wooll, or Wooll fit for combing, Fullers-earth Fulling-clay, Tobacco-pipe-clay, or any other fcouring Earth or Clay from Great Britain or Ireland; o for preventing the Exportation from Ireland into Foreign Parts, of Cloth, Serges, Bays, Kerfeys Frizes, Druggets, Shalloons, Stuffs, Cloth-ferges, or any other Drapery made of or mixed with Wool manufactured in Ireland, may be entered and profecuted (except where it is in this Act otherwife di- jectedj in any of his Majefty's Courts of Record at TVeJlminJler, or in the Court of Exchequer in Scot- land, or at the Quarter-Seffions of the Peace, or before any two Juftices of the Peace for any County City or Place in this Kingdom, in a fummary Way, at the Election of the Seizer or Informer, or bj any Law relating to the Revenue of Ireland, in that Kingdom; wherein no Effoin, Protection or Waga Qnusprobanai to ot Law (hall be allowed, or any more than one Imparlance; and if the Property thereof be claimed by he upon trie any Perfon or Perfons, in fuch Cafe the Onus probandi fhall lie upon the Owner or Claimer thereof. njsvner. anQ; not on t ne Officer or Seizer; any thing in this or any other Act contained to the contrary not- withftanding. XIX. And be it further enacted by the Authority aforefaid, That all the Forfeitures and Penalties before in this Act mentioned and appointed, except where the fame is otherwife directed by this Act, (hall be to the Ufe of fuch Perfon or Perfons as fhall feize, inform or fue for the fame, in the ?'J .inner herein before directed. XX. And be it further enacted by the Authority aforefaid, That on the Condemnation of any Wooll, or any other of the Species of Goods before enumerated, the faid refpective Commiffioners (hall and may caufe all fuch Goods to be publickly fold to the belt Bidder, at fuch Places as the faid Com- rniiiloners (hall think proper; any Law, Cuftom, or Ufage to the contrary in any wife notwithstand- ing; and out of the Produce of fuch Sale, they fnall caufe to be paid all Charges of Condemnation 2nd Sale, and the Remainder to fuch Perfon or Perfons who (hall feize, inform or fue for the fame as aforefaid. Provifion XXII. And be it further enacted and declared by the Authority aforefaid, That if any Perfon or fender is unable P er f°ns, Offender or Offenders, (hall, by Conviction, Judgment or otherwife, become liable to the to pay the 3 s, " Payment of the Penalty of three Shillings per Pound Weight, inflicted by this or any former Ad made Penalty. 10 prevent the Exportation of Wooll, for fuch Wooll, or other the Species before-mentioned, and (hall not be of fufficient Ability to pay the fame, by which Means the Informer or Profecutor will lo!e the Benefit of fuch his Information and Profecution; then and in fuch Cafe it (hall and may be lawful for the refpective Commiffioners to caufe one Shilling per Pound Weight for all fuch of the laid Goods, for which fuch Offender or Offenders (hall be convicted, to be paid by the Receiver General of the Revenue under the Management of the refpective Commiffioners, out of anv publick Money in his Hands; and the Money paid by any Receiver Genera), Cafhier, or other Officer as aforefaid, fhall be accepted of and allowed in his Accounts, as fo much Money paid to his Majefty; and every fuch Officer is and fhall be hereby difcharged thereof accordingly; any Law, Cuftom or Ufage to the contrary notwith- ftanding.

    • Earth or Clay, or in the clandeftine importing from Ireland any Woollen Cloth, Serges, Bays, Ker-

feys, Sayes, Frizes, Druggets, Cloth-ferges, Shalloons, or any other Drapery Stuffs, or Woollen Manufacture, made and manufactured in Ireland; or if the Mate or any of the Mariners of fuch Ship or Vefiel fhall give an Account in fix Months after filth (hipping or exporting any of the Goods before- mentioned, to the Commiffioners of the Cuftoms in England or Scot/and, or to the Commiffioners of the Revenues in Ireland reflectively, of the Name of the Ship or Veffel, and the Species and Quantities - of fuch Goods fo clane'eftinely exported or fhipt for Exportation to Parts beyond the Seas, together with ■ the Name of the Owner or Owners, Exporter or Exporters of fuch Goods, or the Name of the Per- fon or Perfons who act in his or their Aid and Ailiftance, fo as he or they may be profecuted and con- victed for fuch his of their Offence or Offences committed againft this or any other Act in?de to prevent the illegal Exportation of Wooll, or any the Species or Goods before-mentioned; fuch Mafter, Mate ©f Mariner, (hall not only be indemnified for fo doing, but (hall be clearly acquitted and difcharged from 4 m Y
