Penalty vn infuring or procuringWooIl to be landed in foreign Parts. The like Pe- nalty on the infured. Encouragement to Perfons in- furing and in- fured, to make Difcovery. The faid Pe- nalties how to ba recovered. e tain or Ireland before the Expiration of the faid feven Years, he or they (hall fuffer as Felons, and ' have Execution awarded againft them as Perfons attainted of Felony, without Benelit of Clergy ; And ' whereas the faid Act extended only to the Perfon or Perfons who actually exported theWooll or Wooll- ' fells, but not to their Aiders or Abettors ;' Be it therefore enacted by the Authority aforefaid, That the faid Aft, and every thing therein contained, fo far as the fame concerns the Exporters of Wooll or Wooll- fells, (hall extend or be conftrued to extend to all and every Perfon or Perfons who aft as Aiders or Abet- tors to fuch Exporters of Wooll or Wooll-fells, as fully, to all Intents and Purpofes, as if the fame was repeated and re-enacted in the Body of this Act. XXVIII. Provided always, and be it further enacted, That all Bonds taken or to be taken purfuant to this Aft, (hall not be chargeable with any the Duties upon ftampt Vellum, Parchment or Paper; any Law or Statute made or to be made to the contrary notwithftanding. ' XXIX. And whereas it is found by Experience that great Quantities of Wool, Wooll-fells, Wooll- ' flocks, Mortlings, Shortlings, duels, Worried, Woollen and Bay Yarn, Mattraffes and Beds fluffed

  • with combed Wooll, or Wooll fit for combing, are frequently exported from Great Britain or Ireland

' in foreign Parts, and of Woollen Manufactures from Ireland into foreign Parts, to the great Prejudice ' of the Woollen Manufacture of this Kingdom ; which Practice hath of late been much increafed and ' promoted by evil-difpofed Perfons, who, notwithftanding the Laws already made, do undertake as In- ' furers or otherwife, that fuch Goods (hall be delivered in Parts beyond the Seas :' For preventing fo great a Mifchief for the future, be it further enacted by the Authority aforefaid, That from and after the twenty-fifth Day of Deeember one thoufand feven hundred and thirty-nine, all and every Perfon or Perfons whatfoever, who by way of Infurance or otherwife (hall undertake or agree, that any of the Goods or Merchandizes before-mentioned (hall be carried or conveyed to any Parts beyond the Seas from any Port or Place whatfoever, within this Kingdom or Ireland, contrary to the true Intent and Meaning of this Act; or in purfuance of fuch Infarance, Undertaking or Agreement, (hall deliver or caufe or pro- cure to be delivered any of the faid Goods in any Parts beyond the Seas, fuch Perfon or Perfons, and all and every their Aiders, Abettors and Affiftants, (hall, for every fuch Offence, forfeit and lofe the Sum of five hundred Pounds, to the Ufe of the Informer or Profecutor, over and above all other Forfeitures and Penalties to which they are liable by any Act now in Force. XXX. And be it further enacted by the Authority aforefaid, That all and every Perfon or Perfons whatfoever, who (hall pay or agree to pay any Sum or Sums of Money for the infuring, conveying or ex- porting out of this Kingdom or Ireland, contrary to the true Intent and Meaning of this Act, any of the Goods or Merchandizes aforefaid ; (hall, for every fuch Offence, forfeit and lofe the Sum of five hun- dred Pounds to the Ufe of the Informer, or fuch Perfon or Perfons as (hall fue for the fame. XXXI. And be it further enacted by the Authority aforefaid, That in cafe the Infurer, Conveyer or Manager of or in fuch Fraud, or the Perfon or Perfons agreeing to infure, convey or manage therein, do or (hall within the Space of fix Months after fuch Tranfaction or Agreement firft give Notice thereof to the Commiffioners of the Cuftoms in England or Scotland for the time being, or to the Commiflioners of the Revenue in Ireland for the time being, fo as the Perfon or Perfons concerned with him, her or them in fuch Offence be convicted thereof; he, (he or they fo firft difcovering, (hall not only be clearly ac- quitted and difcharged of fuch Offence, and from the Penalties to which he, (lie or they is or are lia- ble by Reafon thereof, but (hall alfo have to his, her and their own Ufe, the whole Forfeiture hereby impofed upon the Party or Parties making fuch Infurance or Agreement, after the Charges of Profecu- tion are deducted ; and (hall likewife retain and enjoy to his, her or their own Ufe the Infurance-money or Reward given or paid to him, her or them, by the Perfon or Perfons concerned with him, her or them therein ; and in cafe the Party or Parties infured (hall, within the like Space of fix Months, firft make Difcovery thereof to the Commiffioners of the Cuftoms in England or Scotland for the time being, or to the Commiflioners of the Revenue in Ireland for the time being, fo as the Perfon or Perfons con- cerned with him, her or them in fuch Offence, be convicted thereof ; he, (he or they fo firft difcovering, (hall recover and receive back fuch Infurance-money or Premium, as he, (lie or they hath or have paid upon fuch Infurance or Agreement ; and in cafe the faid Infurance-money or Premium (hall not at the Time of fuch Difcovery be actually paid, then the Perfon or Perfons fo firft difcovering, is and are here- by faved harmlefs, and indemnified from paying the fame, or any Part thereof; and all and every Agreement and Agreements entered into for paying fuch Monies, is and are hereby declared to be null and void ; and fuch Perfon or Perfons fo firft difcovering (hall alfo have to his, her and their own Ufe the whole Forfeiture impofed upon fuch Infurer, Conveyer or Manager as aforefaid, after Charges of Pro- fecution are deducted ; and (hall alfo be clearly acquitted and difcharged of the Forfeitures hereby im- pofed upon him, her or them. XXXII. And be it further enacted, That all the faid Penalties and Forfeitures incurred by the Per- fons concerned in the fraudulent and illegal Infurances, or Agreements to infure or be infured as before- mentioned, (hall be fued for, profecuted and recovered in any Court of Record at TVeJrminJler, or in the Court of Exchequer in Scotland or Ireland, by Action of Debt, Bill, Plaint or Information, in the Name of his Majefty's Attorney General, or in the Name of any Officer of his Majefty's Cuftoms, Excife, or Salt Duties ; wherein no Eflbin, Protection, or Wager of Law (hall be allowed, or any more than one Imparlance. ' XXXIII. And whereas Policies of Infurance are commonly made on Goods and Merchandizes, as 4 well as on Ships or Veffels, wherein the Infurer undertakes, in Confideration of a Premium given ' him by the affured, to bear all the Rifques and Hazards of the Voyage ; and it is generally unknown ' to the Infurers what Sorts of Goods and Merchandizes are loaded on board any Ship or VcffeL
