C. 29. 365 ri(h or Place, for all or any of the Purpofes of this Act, to be paid by and levied on the Petty Co:ifta- ble of or for any fuch Town, Parifh or Place within the faid Counties refpedtively, in fuch Manner as the lame is herein directed to be paid and levied, in Cafes where no Rate is made for the Relief of the Poor ; any thing herein contained, or any Law, Ufage or Cuftom to the contrary notwithstanding. V. Provided always, and be it enacted by the Authority aforefaid, That this Act, or any thing herein Provifo in fa- contained, fhall not extend or be conftrued to extend to make any Perfons, Liberties, Diviiions or Places vour of' Place* liable to pay to any Rate to be made in purfuance of this Ad, to which fuch Perfon, Liberty, Divifion hcr V ,of " re not or Place did not, or was not liable to contribute before the pairing hereof; but that it (hall and may be Such ° Um * lawful to and for the Juftices of the Peace at their refpective General or Quarter-Seflions, or the greater Part of them then and there aflembled, to order and afcertain what Proportion of any Rate to be made by virtue of this Act (hall be affeffed on and paid by the feveral Perfons, Liberties, Divifions and Places, who have ufually contributed, or are liable to pay only to one or more of, and not to all the Rates hereby intended to be raifed, and thrown into one general Rate or AfTeflment. VI. And be it further enacted by the Authority aforefaid, That the refpedtive high Conftables (hall, High ConfH- and they are hereby required, at or before the next General or Quarter-Seflions refpedtively after they or !?l es !°,l"' 1 f he any of them (hall have received fuch Sum or Sums of Money, to pay the fame into the Hands of fuch Treafurers'ap- Perfon or Perfons (being refident in any fuch County, Riding, Divifion, City, Liberty or Place where ported by the fuch Rates (hall be refpedtively made) whom the faid Juftices (hall at their refpeclive Genera] or Quarter- QH arter - Se,ri - Seflions, or the greater Part of them then and there aflembled, appoint to be the Treafurer or Trea- ° nt> ' i furers (which Treafurer or Treafurers they are hereby authorized and impowered to nominate and ap- ] point) fuch Treafurer or Treafurers rirft giving fufficient Security in fuch Sums as (hall be approved of J by the faid Juftices at their refpeclive General or Quarter-SeiHons, or the greater Part of them then and there aflembled, to be accountable for the feveral and refpeclive Sums of Money which (hall be refpedtively paid to them in purfuance of this Act, and to pay fuch Sum or Sums of Money as , fhall be ordered to be paid by the Juftices in their General or Quarter-SeiTions, and for the due and faithful Execution of the Trufts repofed in him or them ; and all and every fuch Sum or Sums of Mo- ney as (hall be paid into his or their Hands by virtue of and in purfuance of this Act, (hall be deemed and taken to be the publick Stock ; and the faid Treafurer or Treafurers (hall and are hereby required to and they to pay fo much of the Money in their Hands, to fuch Perfon and Perfons as the faid Juftices at their refpec- wnomfoever tive General or Quarter-Seflions, or the greater Part of them then and th;re affembled, (hall by their JJj e Jj^ iC fl. s Orders from time to time direct and appoint, for the Ufes and Purpofes of the faid recited Acts, and ' " e ' for any other Ufes and Purpofes to which the publick Stock of any County, City, Riding, Divifion or Liberty, is or fhall be applicable by Law. VII. And be it further enacted by the Authority aforefaid, That the faid refpedtive Treafurer or Trea- Treafurers to furers fhall and are hereby required to keep Books of Entries of the feveral Sums refpedtively received £ eep Books of and paid by him or them in purfuance of this Act ; and is and are alfo hereby required to deliver in and^account- true and exact Accounts upon Oath if required (which Oath the faid Juftices at their refpedtive General u P°n Oath. or Quarter-Seflions are hereby impowered to adminifter) of all and every the Sum and Sums of Money refpedtively received and paid by him or them, diftinguilhing the particular Ufes to which fuch Sum or Sums of Money have been applied, to the Juftices at every General or Quarter-Seflions refpedtively to be holden within the Limits of their Commifiions ; and fhall lay before the Juftices at fuch Seffions the proper Vouchers for the fame. VIII. And be it further enacted by the Authority aforefaid, That the refpective high Conftables fhall High Confta-- and they are hereby required to demand and levy fuch Rates and AfTefTments in Manner before direct- bles char S e - ed, and fhall account for the fame before the faid Juftices at their refpedtive General or Quarter-Seflions, if thereunto required, in the like Manner as the faid Treafurer or Treafurers is and are hereby direct- ed to account ; and in cafe fuch high Conftables, or any of them, fhall neglect or refufe fo to demand, Penalty on De- levy or account, then it fhall and may be lawful to and for the faid Juftices, at their refpedtive General fault > or Quarter-Seflions, or the greater Part of them then and there affembled, to commit fuch high Con- ftable or high Conftables to the common Gaol of the County, Riding, Divifion, City, Town Corporate, Liberty or Place, there to remain without Bail or Mainprize, until he or they fhall have caufed fuch Rates or Afleflments to be demanded and levied, and fliall have rendered a true Account or Accounts in the Manner hereby diredted ; and in cafe it fhall appear by fuch Account or Accounts, that any Sum or Sums of Money is or are remaining in his or their Hands, which he or they fhall have received of the refpective Churchwardens and Overfeers or other Perfons which ought to have been paid to the re- fpedtive Treafurer or Treafurers at the Time or Times limited by this Act, or of the refpective Trea- furer or Treafurers, in order to be applied to the Purpofes aforefaid ; and if he or they fhall neglect' or refufe to pay the fame over into the Hands of the refpective Treafurer or Treafurers, or otherwife,. if thereunto required by Order of the faid Juftices at their refpective General or Quarter-Seflions, or the greater Part of them then and there aflembled ; then it fhall and may be lawful for the faid Ju- ftices at fuch their General or Quarter-Seflions, or the greater Part of them then and there affembied,. to commit fuch high Conftable or high Conftables to the Common Gaol of the County, Riding, Divi- fion, City, Town Corporate, Licerty or Place, there to remain without Bail or Mainprize, until he or they fhall have made fullPayment of the Sum or Sums of Money that fhall appear to be due on fuch Account or Accounts ; and all the Accounts and Vouchers of the faid Treafurers and high Conftables v ouc j, ers to fhall, after having been palled by the faid Juftices at their refpedtive General or Quarter-Seflions, be be kept 'among- depofited with the Clerk of the Peace for the time being, of each County refpedtively, or the Town- th f Records Clerk, High Bailiff, or Chief Officer of any City, Town Corporate or Liberty, who is and are hereby £ c ™ Count *» required to keep them among the Records of fuch County, City, Town Corporate or Liberty, to be ' infpected
