A. D. 1740. Anno decimo tertio Georgii II. C. Q--ir. 389 ed, for or concerning any Work done in that Manufacture, fliall and may be heard and determined by any two Juftices of the Peace of the County, Riding, Diviiion, City, Town or Place, where the Mat- ter in Controverfy fliall happen or arife, who are hereby impowered to fummon and examine Witneffes on Oath or Affirmation, concerning the fame, which Oath or Affirmation the laid juftices are to admi- nifter and take. VIII. Workers faid, fand Boots, Shoes, Slippers or other Wares as aforefaid, for any one Matter, and lhall neglect the Performance thereof, either by procuring or permitting himfelf to be l'ubfequcntly retained or employed by any other Mailer or Perfon whatfoever, before he or they lhall have compleated the Work or Service in or to do which he or they was or were firft and originally fo retained or employed, and fliall be firft delivered to him or them ; then, and in every fuch Cafe, every Perfon fo offending, being thereof lawfully convicted by the Oath or Oaths, Affirmation or Affirmations, of one or more credible Witnefs or Witneffes, be- fore one or more Juftice or Juftices of the Peace, where the Offence or Offences fliall be committed, the or b £ f ^ x ■? Perfon or Perfons fo convicted (hall be fent to the Houfe of Correction, there to be kept to hard Labour correfHon for for any Time not exceeding one Month. a Month. IX. Provided always, and be it further enacted by the Authority aforefaid, That if any Perfon- or Perrons ag _ Perfons fliall think him, her or theirtfelves aggrieved by any Judgment or Order of the faid two Juftices^ gneved may it (hall and may be lawful for fuch Perfon and Perfons to appeal from the Judgment, Order and Determi- a PP eal t0 '>> e nation of the faid two Juftices, to the Juftices of the Peace at their next General Quarter-Seffions of the Seffions i Peace, to be held for the fame County, Riding, Divifion, City, Town or Place, where the Matter in Difpute fliall arife (giving eight Days Notice of fuch Appeal to the Perfon or Perfons againft whom g iving eignt . fuch Appeal fliall be brought and profecuted); and fuch Juftices of the Peace, at their next General Days Notice. Quarter-Seffions, are hereby impowered to fummon and examine Witneffes on Oath or Affirmation (which Oath or Affirmation they are hereby impowered to adminifter and take) and to hear and finally determine the Matter of the faid Appeal, and at fuch Quarter-Seffions fliall award and order to the Party on whofe Behalf fuch Appeal is determined, fuch reafonable Cofts and Charges tobe paid by fuch Appellant, or by the Perfon or Perfons appealed againft, in Regard of fuch Appeal, as to the faid Juftices, or the major Part of them, fliall feem meet ; but no Order made by the faid Two Juftices of the Peace as aforefaid fliall be appealed from, quafhed or vacated for want of Form only. X. Provided always, and it is hereby enacted and declared, That no Perfon (hall by virtue of the faid Provifc recited Act, or this Act, fuffer the Punifhments therein directed twice for one and the fame Fact and Offence. XI. And be it further enacted by the Authority aforefaid, That the faid recited Act paffed in the firft A<ft i Ann*, Year of the Reign of her late Majefty Queen Anne (and made perpetual as aforefaid) and this prefent and tllis ^ ft > Act, and all the Claufes, Provifions, Pains, Penalties and Forfeitures therein and herein contained, fliall sco^and. t0 from and after the firft Day of May one thoufand feven hundred and forty, extend and be conftrued and adjudged to extend and be put in Force, in that Part of Great Britain called Scotland, in as full and ample Manner as the before-mentioned Acts are to be put in Force and executed in that Part of Great Britain called England ; and the Pains, Penalties and Forfeitures, which fliall be incurred by virtue of • the before-mentioned Acts, or either of them, fliall be inflicted, levied and taken in the fame Manner, and by fuch Ways and Means, as the Pains, Penalties and Forfeitures are in and by the before-men- tioned Acts, or either of them, directed, ordered and appointed ; and if any Offence againft this Act fliall be committed within that Part of Great Britain called Scotland, and determined by one or more Ju- ftice or Juftices of the Peace, as herein before directed, no Warrant for poynding or diftraining that lhall be iffued by any one or more Juftice or Juftices of the Peace, fliall be (topped, or fifted by any Sufpenfion, Sift, or other Procefs whatfoever, except an Appeal entered to the Quarter-Seffions of the see further Peace, as herein before directed.. 22 c«. 2. c . 27; CAP.
