' and pofl'efs Lands, Tenements and Hereditaments, to the Value of four thoufand Pounds a Year, and ' Goods, Chattels and Perfonal Eftate of what Nature and Value foever ; and to purchafe or erect an ' Hofpital for the Support, Maintenance and Education of Expofed and Deferted young Children ; and 4 to hold Courts to make By-laws, and to elect Governors and Officers, and to do other Acts for the ' Purpofes of the faid Charter : And whereas great Sums of Money have been given by the Governors ' of the faid Hofpital, and other Perfons, to be applied to the charitable Ufes before mentioned: And ' whereas by Reafon of the Laws now in Force for the Relief of the Poor many Difficulties may arife ' in carrying into Execution the good Intents of the faid Charter, and that the granting other and fur- ' ther Powers to the faid Corporation is requifite, effectually to anfvver the Purpofes aforefaid ;' May it pleafe your Majefty that it may be enacted, c?V. Preamble, re- citing the Afls 9 & 10 W. 3. . c. 19. and 5 Geo. 1. c, 31. " Hofpital may purchafe Lands, &c. not exceeding 4000/. per Ann. Taxes on Lands, &? c. not to be " raifed above what was paid in 1739 ; though improved for the Ufe of the Corporation. Conveyances " to be approved of by the Lord Chancellor, &c. Corporation to maintain and educate as many Chil- " dren as they think fit. No Churchwarden, fcfV. to hinder any Perfons bringing their Children to the " Hofpital, on Penalty of 40 s. No ParHh Officer fhall have any Authority in the Hofpital. No Settle- " ment by being educated in the Hofpital. No Fees due to any Parilh for Chriftenings or Burials. " Corporation to provide Minifter and Burial Ground. Children may be lett for Hire to work abroad " for the Ufe of the Hofpital. Prefident, fcff. to be chofen annually. On Death of Prefident, fy. An Aft for further enlarging the Term granted by an Aft of the ninth and tenth Years of the Reign of King William the Third, For cleanfing and making navigable the Chanel from the Hithe at Colchefter to "Wivenhoe ; and for making the laid Aft, and another Aft of the fifth Year of the Reign of his late Majefty King George the Firft, For enlarging the 'Term granted by the faid A& of the ninth and tenth Tears of the Reign of King William the Third, more effeftual. P R. WHEREAS an Act paffed in the ninth and tenth Years, of the Reign of his late Majefty King William the Third, intituled, An Alt for cleanfing and making navigable the Channel from tht Hithe at Colchefter to Wivenhoe ; which Act was made to continue from the firft Day of May one thoufand fix hundred and ninety-eight, for and during the Space of one and twenty Years, during which Term certain Duties were by the faid Act laid upon fuch Goods, Wares and Merchandizes, for the Purpofes aforefaid, as in the faid Act are mentioned ; upon the Credit of which Act the Mayor of Colchefter, and the Juftices of the Peace for the Eaft Diviiion of the County of EfJ'ex, the Commif- fioners therein appointed, had purfuant to the Authority thereby given borrowed Monies for the more fpeedy and effectual compleating of the faid Work ; but the faid Duties falling fhort, there had not been fufficient raifed thereby, either to perfect the faid Work, or to pay the whole Money borrowed for that Purpofe ; and the Sum of one thoufand and two hundred Pounds, or thereabouts, was in the Year one thoufand feven hundred and nineteen remaining due to the Executor of William Hewer, late of Clapham in the County of Surrey, Efquire, upon Security of the.Premiffes, which could not be re- paid, nor the faid Channel be effectually repaired and amended according to the Intent of the laid Act, unlefs a further Provifion was made by Parliament, and the faid Act made more effectual : And whereas by an Act paffed in the fifth Year of the Reign of his late Majefty King GecrgEj intituled, An Ad for enlarging the Time granted by an Acl of the ninth and tenth Years of King William, For cleanfing and making navigable the Channel from the Hithe at Colchefter to Wivenhoe, and for making the faid Acl more effeclual (reciting as before- is recited) it was enacted, That the faid former Act, and all the Powers and Authorities thereby given, and all and every the Claufes, Provifoes, Matters and Things therein contained, and not thereby altered, fhould, for railing, levying, collecting, fecuring of, and accounting for the Rates and Duties thereby granted or. continued, and to that End for levying and recovering the Penalties and Forfeitures mentioned in the faid former Act, and for other the Pur- pofes of that Act, be continued, and be in full Force and- Effect from the firft Day of May, which fhould be in the Year of our Lord one thoufand feven hundred and nineteen (when the faid former recited Act would expire) until the firft Day oi'May, which fhould be in the Year- of our Lord one thoufand feven hundred and forty, being a further Term of twenty-one Years, as fully and effectually to all Intents and Purpofes, as if the fame were particularly and at large repeated and re-enacted in the Body of the faid laft recited Act; and it was thereby. further enacted, That the Duties granted by vir- tue of the faLd laft recited Act fhould be one Moiety or Half Part of the Duties granted by the faid former Act, and no more, and all Corn or Grain whatfoever fhould be wholly exempted : And where- as iince the parting the faid laft recited Act the Money due to the Executor of William Hcuti has been paid, and the Commiffioners have erected a very large Lock on the faid Chanel, which has been found by Experience to be of very great Ufe and Service to the Navigation thereof; and for- afmuch as the A4aintenance and Reparation of the faid Lock will be a continual Expencc, and the Term- in the faid laft recited Act will expire the firft Day of May one thoufand feven hundred and forty, and the Lock after that Time cannot be fupported, and the Chanel be kept ckanfed and fit for Navigation, unlefs fome further Provifion be rriade by Parliament for the fame, and. a Power be given to the Com- 8 ' mifiioners
