Penalty on Col- lector's refufing Which Oath or Affirmation (hall be taken without any Fee or Reward, and without any Stamp thereon • and which Oath or Affirmation the Alderman of every of the refpective Wards in the City of London for ty of London for the i ime being, or their refpective Deputies, are hereby impowered to adminifter, as the Cafe fhall re- quire : to take the Oath, or or to acl. Penal y. or ta If a Ptrfon fhall refufe to take the Office, or fliall the or remove fnhieft to the like Penalty for not taking the Oath, or acting Piovifu. Colleflors to ac- count on Oath, tent and Meaning of this Act, he fhall forfeit and pay the Sum often Pounds to be applied to, and made Part of the Fund for providing and maintaining fuch Lights within the faid City and Liberties as afore- faid, to be by the Aldermen or his Deputy of the Ward where fuch Neglect or Refufal fhall happen re- ceived and paid into the Chamber of London for that Purpofe; and fuch Collector fhall continue liable to be chofen into the faid Office again the Year following, or at any other Time; and in cafe of his Refu- fal, fliall be again liable to the like Penalty, and fo as often as he fhall refufe or neglect to take upon him the faid Office, and duly execute the fame. XII. And be it further enacted by the Authority aforefaid, That when any Perfon fhall refufe or neg- lect to take upon him the faid Office, when chofen thereto, or to execute the fame, or fhall happen to depart this Life, or remove out of the Ward in which he fhall be chofen and appointed, before he has out of the Ward, finifhed his Collection, it fhall and may be lawful for the Aldermen of the Ward for the Time being another ftaii be when the Cafe fhall fo happen, with the Advice and Confent of his Deputy and Common Council Men' chofen, or the ma j 01 - p ar t of them, by Appointment under their Hands and Seals, to nominate and appoint fome other Perfon within fuch Ward, to collect all fuch Sum and Sums of Money as fhall remain due and un- paid of fuch Rate and Affeffment as aforefaid : And if fuch other Perfon fo appointed fhall neglect or re- fufe to take and fubferibe the faid Oath, or being one of the Perfons called Quakers, the faid Affirmation or to ferve the faid Office, then and in fuch Cafe, fuch other Perfon fo neglecting or refufing fhall be lia- ble to the like Penalties with thofe who neglect or refufe to ferve the Office when chofen at the Ward- mote as aforefaid. XIII. Provided always, and be it further enacted, That nothing in this Act fhall be conftrued to ex- tend to oblige any Perfon or Perfons to ferve the faid Office of Collector, who by the Laws now in beinp- are exempted from ferving any Parilh or Ward Office. XIV. And be it further enacted, That the feveral Collectors for the feveral Wards within the City of London, and the Liberties thereof, for the Time being, fhall as often as they fhall be respectively requi- on 7 DaysNotice. red, and on feven Days Notice in Writing given to or left for them refpectively, at his or their ufual Places of Abode within the faid City or Liberties thereof, by the Alderman of the refpective Ward wherein fuch Collector or Collectors fhall live, or his Deputy and Common Council, or the major Part of them, deliver in upon Oath (or Affirmation, if fuch Collector be a Shaker) if thereunto required, unto every fuch Alderman, or his Deputy and Common Council, or the major Part of them, at fuch Time and Place as they fhall appoint within their refpective Wards (which Oath or Affirmation the laid Alder- man or his Deputy are hereby impowered to adminifter) a true, exact and perfect Account in Writing under the refpective Hands of fuch Collector or Collectors, of all Sums of Money, which he or they fhall have received, by reafon of his or their faid Office, and alfo a true Lift of the Names of all Perfons in their refpective Wards, who fhall have neglected or refufed to pay the Rates and Affeffments laid on them as aforefaid; and of the feveral Sums from him, her or them refpectively due and in Arrear, to the Intent that the fame may be fpeedily got in and recovered; and if any Collector or Collectors, after fuch No- tice given, fhall neglect or refufe to bring in his Accounts as aforefaid, or to account for any Sum or Sums of Money by him or them collected and received, and to pay the fame, and every Part thereof as is hereby appointed, it fhall and may be lawful to and for the Lord Mayor or Alderman of the faid Ward for the Tims being, to commit fuch Collector or Collectors to one of the Compters within the faid City, there to remain without Bail or Mainprize, until he or they fhall have rendered and made a true and per- fect Account and Payment as aforefaid, or fhall make fuch Compofition as the faid Lord Mayor or Al- derman fhall think juft and reafonable. XV. And be it further enacted, That if any Perfon or Perfons fhall neglect or refufe to pay the Sum or Sums of Money on him or them rated and affeffed by virtue of this Act, for the Space of feven Days after perfonal Demand thereof, or Demand in Writing left at the Place of Abode or Occupation within the faid Ward of fuch Perfon or Perfons fo rated and affeffed, that then and in every fuch Cafe, it fhall and mry be lawful to and for fuch Colleftor or Collectors appointed to receive the faid Rates or Affeff- ments, by Warrant under the Hand and Seal of the Lord Mayor or Aldermen of the faid Ward (which iirefstote gran- Warrant the faid Lord Mayor or Alderman is hereby authorized and required to grant) by and with the ted by the Loid Affiftance of a Conftable of the faid Ward {who is hereby required to be aiding and affifting) to enter Mayor or Alder- j nt0 any p art of the Premiffes within the faid Ward, occupied by the Perfon or Perfons fo rated and af- feffed > and to diftrain his and their Goods and Chattels; and if the fame fhall not be replevied, or the Monies paid within feven Days after fuch Diftrefs made, together with the Cofts of making fuch Diftrefs to be afecrtained by the Lord Mayor for the Time being, or the Alderman of the Ward wherein any fuch Diftrefs fhall be fo made, then to appraife and _ fell fo much, and fuch Part thereof, as will be fufficient to pay the faid Rate and Affeffment, together with all Cofls and Charges attending the faid Diftrefs, re- turning the Overplus, if any, to the Owner or Owners of fuch Goods and Chattels : And if any Alder- man of any Ward within the faid City of London, fhall refufe to grant fuch Warrant when demanded by the Collector appointed to collect the faid Rate and AffelTrnent, fuch Alderman fliall, for every Time he fhall fo neglect or refufe, forfeit and pay unto the Chamberlain of the City of London for the Time bein™- to Penalty on Col lectors refufing to account, and pay the Money collected. .Collector may levy by Difliefs and Sale.
