Officers for getting in Arrears of Salt &utk-s. or Demand of any Perfon or Perfons, in purfmnce of the faid recited Acts or any of them, on his or their exporting beyond the Seas any Salt, for which the faid Duties had been before fecured or paid, to have the Securities for the fame dilcharged or the Monies pa d for the fame repaid, (hall alfo ceafe and determine, as to fo much of fuch Securities or Payments, as were given or made for any of the Duties by this Act to be determined, and that no Drawbacks on account of fuch Duties fo fecu- red or paid before the faid twenty-fifth Day of December which (hall be in the Year of our Lo d one thousand feven hundred and thirty (except for the Duty of three Pence per Gallon on Foreign Salt impofed by the firft herein rected Act) (hall be made and allowed on any Salt exported beyond the Seas after that Time. III. Provided always, That nothing in this Act con'ained (hall extend or be conftrued to extend to determine the faid Duty of three Pence per Gallon on Salt not of the Product or Manufacture of the Kingdom of England, Dominion of Wales, or Town of Berwick upon Tweed, fo as aforefaid granted by the faid A<t of the fifth and fixth Years of the Reign of their late Majefties King William and Queen Mary, and fince made perpetual ; nor (hall the fame extend or be conftrued to extend to de- termine or make void any the Provifions, Rules or Directions, made or given by the faid Acts or any of them, and now in Force, for Payment of the fame Duty by the Importers of fuch foreign Salt upon the Entry thereof, or for preventing the Landing thereof before fuch Entry made, or the fecu- ring the fame by Bond with fufficient Sureties, or for allowing the Difcounts on paying the faid Duty in ready Money, or for Allowances for Drawbacks of the Duties paid or fecured on the re-exporting the fam? for foreign Parts, or for making good any LolTes or Accidents that may happen in fuch Salt after (hipping the fame for Exportation to foreign Parts, or to be carried coaftwife, or for afcertaining the Weight in each Bufhel, by which the faid Duty (hall be computed, or to determine or make void any former Act or Claufe relating to Ships or Veflcls laden with foreign Salt found hovering on the Coalt,, or relating to fuch Salt exported to Ireland, and landed there ; but the fame and every of them (hall re- main and be in as full Force and Virtue as they now are or would be if this Act had not been made, or as if the fame had been particularly repeated and re-enacted in the Body of this Act ; any Thing herein, contained to the contrary thereof notwithstanding. III. Provided neverthelefs, and be it enacted by the Authority aforefaid, That the faid Duty of three' Pence per Gallon on foreign Salt fhall extend only to fuch Salt as is not the Product and Manufacture of fome Part of the whole united Kingdom of Great Britain, and that all Salt of the Product or Ma- nufacture of that Part of Great Britain called Scotland (hall be exempted from the faid Duty, as well a* Salt of the Product or Manufacture of that Part of Great Britain called England is exempted from the fame, by the Defcription of the faid Duty in the faid firft recited Act which originally granted the fame. IV. Provided alfo, and be it enacted by the Authority aforefaid-, That nothing, herein contained fhalL extend or be conftrued to-extend to determine or make void any the Penalties or Forfeitures inflicted or im- pofed by the faid former Acts or any of them, and now in Force, for any Offences in the landing of fuch foreign Salt before Entry, or for any other Frauds or Abufes upon the re-exporting the fame, in Relation to the Drawbacks of Duties which had been before paid upon the fij ft importing the fame, and afterwards relanding the fame in. any Part of Great Britain clandestinely, or for any other Offences againft the faid Acls, in Relation to the fame Duty, nor to alter any Provifions now in Force for" the Diftribution of the faid Penalties and Forfeitures between his Majefty and the Informers, when recovered,, or the Method of fuing for or recovering the fame, fave only that from and after the faid twenty-fifth Day of December which fhall be in the Year of our- Lord one thoufand feven hun- dred and thirty, the Provifions for fuing for, recovering, receiving or mitigating the fame, by the fame Means, Rules, Ways and Methods as any Penalty or Forfeiture is to. be fued for or recoverable by'- any Laws relating to the Excife, (hall ceafe and determine ; and then and from thenceforth the fame (hall be hied for, levied, recovered and received for any Frauds or Offences that fhall be commit- ted in, that Part of Great Britain called England, by Action cf Debt, Bill, Suit, Plaint or Informa- tion in any of his Majefty's Courts of Record at IVeJhninJhr, and for any Frauds or Offences that fhall be committed in that Part of Great Britain called Scotland,, in. the. Court of Exchequer at Edin- burgh, wherein no Effoign, Protection or Wager of Law fhall be allowed, or any more than one Im- parlance. V. Provided always, That in any Cafes where any Provifions are made by. any former Acts of Parliament for fuing for, profecuting or recovering any Penalties or Forfeitures for any Offences or Frauds in Relation to the faid Duties, before any two or more Juftices of the Peace, the fame Powers- or Provifions for fuing for, prosecuting or recovering the fame before fuch Juftices of the Peace, in Rela- tion to the faid Duty of three Pence per Gallon on foreign Salt, (hall co .tinue in full Force, and be put. in Execution ; any Thing herein contained to the contrary notwithftanding. VI. Provided alio, That nothing in this Act contained (hall extend or be conftrued to extend to acquit, relcafe^or difcharge any Importers or Makers or Proprietors of Salt or Rock Salt from any Duties due or to grow due for Salt imported, or. Rock Salt taken out of the Pits, or Salt made and removed, before the faid twenty-fifth Day of December one thoufand feven hundred and thirty; or any Securities- for the fame,, or any Penalties or Ptnteitures incurred, or to which any Perfon. or Perfons was, were cr fhall become liable for any Frauds or Offences in Relation to the faid Duties before that Time ; but the fame, fliall remain due,, payable, fuable for and recoverable in the -fame. Manner as they would have been if this Act had not been made. VII. And be it declared and enacted by the Authority aforefaid, That it fliall and may be lawful for the Lords Commilhoners of his Majefty's Treafury, or any three or more of them, or the Lord High ±.
