A. D. 1730. Anno tertio Georgii If. C. 27. 33 ■ their Coals, which Places of Sale are hereby declared to be the refpective Wharfs, Warehoufes, Docks, Sheds, Cellars, or other Repofitories, for the Coals of fuch Perfons as are Dealers therein, and that all Perfons dealing in Coals, who fhall from and after the firfr. Day of Augujl one thouland (even hundred and thirty offend herein, fhall for every fuch Offence forfeit and pay the Sum of fifty Pounds ; and that all Perfons who ihall, from and after the firft Day of Augujl one thouland feven hundred and thirty, alter and make lefs any fuch Bufhel or other Meafure, or any of the Sacks before mentioned, after the fame have been fealed or marked as aforefaid, fhall for every fuch Offence forfeit and pay the Sum of fifty Penalty. And for the better Difcovery of the Offences herein before-mentioned, Be it further enacted by offenders a- the Authority aforefaid, That any Perfon who lhall be guilty of any of the Offences declared by this gainftthis Aft Act, and mall, within fix Calendar Months after fuch Offence fhall be committed, make an effectual VtherOftendcrs, Difcovery of any Coal Owner or Coal Owners, Proprietor or Proprietors of a Colliery or Collieries, or acquitted. of his or their Agent or Agents, Servant or Servants, or of his, their or any of their Fitters, Officers or Clerks, or of any Mafter or Owner of any Ship or Veffel, or of any Lighterman, Crimp, Coal Factor, or Seller or Retailer of Coals, or other Perfon concerned in the Coal Trade, who fhall have committed >any Offence contrary to the true Intent and Meaning of this Act, fo as he, they or any of them ihall be convicted of any fuch Offence, fuch Perfon making fuch Difcovery (hall he, and is hereby fully dif- charged of and from the faid Penalties and Forfeitures for all fuch Offences by him before that Time committed, and fhall alfo be intitled to have and receive the fame Benefit and Advantage from fuch Dif- covery and Conviction, as any other Perfon fhall in the like Cafe be intitled to by Virtue of this Act. XVI. And be it further enacted by the Authority aforefaid, That all and Angular the Penalties and Penalties hour Forfeitures for Offences in this Act mentioned, above the Sum of five Pounds, fhall be one Moiety t0 be levied - thereof to his Majefty, his Heirs and Succeffors, and the other Moiety thereof to him or them who fhall inform and fue for the fame within the Space of fix Calendar Months next after fuch Offence or Offences fhall be committed, to be recovered with double Cofts of Suit by Action of Debt, Bill, Plaint or In- formation in any of his Majefty's Courts of Record, wherein no Effoin, Protection or Wager of Law ihall be allowed, nor more than one Imparlance given ; and that all Penalties and Forfeitures for Of- fences in this Act mentioned, of or under the Sum of five Pounds, ihall be recovered by way of Com- plaint made unto the Lord Mayor of London for the Time being, or any one Juffice of the Peace within the City of London and Liberties thereof, or one Juflice of the Peace of the feveral and refpective Coun- ties and Places where fuch Offender or Offenders fhall live, who are hereby required to call the Parties before them, and to hear and examine fuch Complaint upon Oath, which by Virtue of this Act is to be by him adminiftred, and upon due Proof thereof made to his Satisfaction, to grant a Warrant under his Hand and Seal for levying fuch Forfeitures accordingly ; the one Moiety thereof to be to and for the Ufe of the Informer, and the other Moiety thereof to be to and for the Ufe of the Poor of the Parifh where fuch Offence or Offences fhall be committed : and in cafe fuch Forfeitures fhall not be forthwith after fuch Conviction or Convictions paid, that then the fame ihall be levied by Diftrefs and Sale of fuch Offender's Goods and Chattels by Warrant or Warrants under the Hand and Seal of the Lord Mayor of London, or fuch Juftice of the Peace before whom fuch Offender or Offenders fhall be convicted, ren- dring the Overplus, if any fhall be, to fuch Offender or Offenders ; and for want of fufficient Diftrefs or Diftreffes fuch Offender or Offenders fhall be committed to the Houfe of Correction for any Time not exceeding thirty Days, and not lefs than fourteen, there to be kept to hard Labour. XVII. And be it further enacted by the Authority aforefaid, That this Act fhall be deemed and taken publickAft. to be a publick Act to all Intents and Purpofes, and fhall be judicially taken Notice of as fuch by all Concerning Coats Judges, Juftices and other Perfons whatfoever, without the fame being ipecially pleaded or fet forth.
