And be it further enafted by the Authority aforefaid, That if any High Conftable, Con- nev to excure any Per- ft a b] ej Bedel, or other Officer or Perfon whatfoever, who, by virtue or colour of this Aft, fliall on torn quartering, quarter or billet, or be employed in quartering or billeting, any Officers or Soldiers, fliall neglect or refufe, for the Space of two Hours, to quarter or billet fuch Officers or Soldiers when thereunto required, in fuch manner as is by this Aft direfted, provided fufficient Notice be given before the Arrival of fuch Troops ; or fliall receive, demand, contraft or agree for, any Sum or Sums of Money, or any Reward whatfoever, for or on account of excufing, or in order to excufe, any Perfon or Per-, fons whatfoever from quartering or receiving into his, her or their Houfe or Houfes any fuch Officer or Victuallers refufuig Or Soldier; or in cafe any Viftualler, or any other Perfon, liable by this Aft to have any Officer or to juarter Soldiers. Soldier billeted or quartered on him or her, fliall refufe to receive or viftual any fuch Officer or Sol- dier, fo quartered or billeted upon him or her as aforefaid ; or fliall refufe to fiirnifh or allow, accord- ing to the Directions of this Aft, the feveral Things herein before refpeftively direfted to be fur- nished or allowed to Non-commiffion Officers and Soldiers fo quartered or billeted on him or her as aforefaid, or fliall negleft or refufe to furnifh good and fufficient Hay and Straw for each Horfe fo rjuartered or billeted on him or her as aforefaid, at the Rate herein before-mentioned, and fliall be thereof convicted before any one or more Juflice or Juffices of the Peace of the County, City or Liberty, within which fuch Offence fliall be committed, either by his own Confeflion, or by the Oath of one or more credible Witnefs or Witneffes (which Oath the faid Juftice or Juftices is and are hereby impowered to adminifter) every fuch High Conftable, Conftable, Bedel, or other Officer er Perfon fo offending, fliall forfeit, for every fuch Offence, the Sum of five Pounds, or any Sum of Money not exceeding five Pounds, nor lefs than forty Shillings (as the faid Juftice or Juftices, before whom the Matter {hall be heard, fliall, in his or their Difcretion, think fit) to be levied by Diftrefs and Sale of the Goods of the Perfon offending, by Warrant under the Hand and Seal, or Hands and Seals, of fuch Juftice or Juftices, before whom fuch Offender fliall be convifted, or of one or more of them, to be direfted to any Other Conftable within the County, City or Liberty, or to any of the Overfeers of the Poor of the Parifh where the Offender fliall dwell; the faid Sum of five Pounds, or the faid Sum not exceeding five Pounds, nor lefs than forty Shillings, when levied, to be paid to the Overfeers of the Poor of the Parifh wherein the Offence ihall be committed, or to fome one of them, for the Ufe of the Poor of the faid Parifh. And, for the better preventing Abufes in quartering or billeting the Soldiers, in purfuance counVoTtheVumteV of this Aa ' Be k further enafted by the Authority aforefaid, That it fliall and maybe lawful to and ot Soldiers quartered, for any one or more Juftice or Juftices of the Peace, within their refpeftive Counties, Cities or Li- &c berties, by Warrant or Order under his or their Hand and Seal, or Hands and Seals, at any Time or Times during the Continuance of this Aft, to require and command any High Conftable, Conftable, Bedel, or other Officer, who fliall quarter or billet any Soldiers in purfuance of this Aft, to give an Account in Writing unto the faid Juftice or Juftices requiring the fame, of the Number of Officers and Soldiers who fhall be quartered or billeted by them, and alfo the Names of the Houfekeepers or -Perfons upon whom every fuch Officer or Soldier fliall be quartered or billeted, together with an Ac- count of the Street or Place where every fuch Houfekeeper dwells, and of the Signs (if any) belong- ing to their Houfes ; to the end it may appear to the faid Juftice or Juftices where fuch Officers and Soldiers are quartered or billeted, and that he or they may thereby bs the better enabled to prevent or punifh all Abufes in the quartering or billeting of them. And be it further enafted, That where any Troops or Parties upon Command have Oc- s>?.y in .paffmg over cafion in their March to pafs regular Perries in that Part of Great Britain called Scotland, it fliall and .1 ernes mScot*nd. m aybe lawful for the Commanding Officer, either to pafs over with his Party as Paffengers, or to hire the Ferry Boat intire to himfelf and his Party, debarring others for that Time, in his Option; and in cafe he fnall choofe to take Paffage for himfelf and Party as Paffengers, he fhall only pay for himfelf, and for each Perfon, Officer or Soldier, under his Command, half of the ordinary Kate payable by fingle Perfons at any fuch Ferry; and in cafe he fliall hire the Ferry Boat for himfelf and Party, he fhall pay half of the ordinary Rate for fuch Boat or Boats ; and in fuch Places where there are no regular Ferries, but that all Paffengers hire Boats at the Rate they can agree for, Officers, with or without Parties, are to agree for Boats, at the Rate as other Perfons do in the like Cafes. Provided neverthelefs, and it is hereby declared by the Authority aforefaid, That from and afer the twenty-fifth Day of March one thoufand feven hundred and fixty-four, when and as,- cVften as any Perfon or Perfons fhall be inlifted as a Soldier orSoldiers in his Majefty's Land Service, he and they fliall, within four Days, but not fooner than twenty-four Hours, after fuch Inlifting re- fpeftively, be carried before the next Juftice of the Peace of any County, Riding, City or Place, or chief Magiftrate of any City or Town Corporate (not being an Officer in the Army), and before fuch Juftice or chief Magiftrate he or they fliall be at Liberty to declare his or their Diffent to fuch In- lifting; and upon fuch Declaration, and returning the Inlifting-money, and alfo each Perfon fo diS. .il-nthig paying the Sum cf twenty Shillings for the Charges .expended or laid out upon him, fuch Perfon iTerfons haftily lilting ihojTiiclves,
