procurement of domestic end product as defined in 48 C.F.R. sec. 25.101: Provided further. That this section shall not apply to EHV power equipment produced or manufactured in a country whose government has completed negotiations with the United States to extend the GATT Government Procurement Code, or a bilateral equivalent, to EIHV power equipment, or which otherwise offers fair competitive opportunities in public procurements to United States manufacturers of such equipment. UfPLEMENTATION OF BUT AMERICAN ACT WITH RESPECT TO CERTAIN WATER RESOURCE PROJECTS

508. (a) GENERAL RULE.—For purposes of title HI of the Act of 41 USC lOa note. March 3, 1933 (47 Stat. 1520; 41 U-S.C. lOa-lOc), commonly known as the Buy American Act, a cofferdam or any other temporary structure to be constructed by the Secretary of the Army, acting through the Chief of Engineers, shall be treated in the same maimer as a permanent dam constructed by the Secretary of the Army. 0 > APPLICABUJTT.—Subsection (a) shall only apply to contracts Contracts. 1) entered into after the date of the enactment of this Act. SEC. 509. Such sums as may be necessary for fiscal year 1989 pay raises for programs funded by this Act shall be absorbed within the levels appropriated in this Act. This Act may be cited as the "Energy and Water Development Appropriations Act, 1989". SEC.
