SEC. 216. ADMINISTRATIVE PROVISIONS. Section 407 of the Agricultural Trade Development and Assistance Act of 1954 (7 U.S.C. 1736a) is amended— (1) in subsection (a)— (A) in paragraph (1), by inserting "or private entity that enters into an agreement under title I" after "importing country"; and (B) in paragraph (2), by adding at the end the following: "Resulting contracts may contain such terms and conditions as the Secretary determines are necessary and appropriate."; (2) in subsection (c)— (A) in paragraph (1)(A), by inserting "importer or" before "importing country"; and (B) in paragraph (2)(A), by inserting "importer or" before "importing country"; (3) in subsection (d)— (A) by striking paragraph (2) and inserting the following: "(2) FREIGHT PROCUREMENT.— Notwithstanding the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 471 et seq.) or other similar provisions of law relating to the making or performance of Federal Government contracts, ocean transportation under titles II and III may be procured on the basis of full and open competitive procedures. Resulting contracts may contain such terms and conditions as the Administrator determines are necessary and appropriate."; and (B) by striking paragraph (4); (4) in subsection (g)(2)— (A) in subparagraph (B), by striking "and" at the end; (B) in subparagraph (C), by striking the period at the end and inserting "; and"; and (C) by adding at the end the following: "(D) an assessment of the progress towards achieving food security in each country receiving food assistance from the United States Government, with special emphasis on the nutritional status of the poorest populations in each country."; and (5) by striking subsection (h). SEC. 217. EXPIRATION DATE. Section 408 of the Agricultural Trade Development and Assistance Act of 1954 (7 U.S.C. 1736b) is amended by striking "1995" and inserting "2002". SEC. 218. REGULATIONS. Section 409 of the Agricultural Trade Development and Assistance Act of 1954 (7 U.S.C. 1736c) is repealed. SEC. 219. INDEPENDENT EVALUATION OF PROGRAMS. Section 410 of the Agricultural Trade Development and Assistance Act of 1954 (7 U.S.C. 1736d) is repealed.
