SEC. 105. OFFICE OF INTELLIGENCE AND ANALYSIS OF THE DEPARTMENT OF THE TREASURY.

(a) ESTABLISHMENT OF OFFICE.—(1) Chapter 3 of subtitle I of title 31, United States Code, is amended— (A) by redesignating section 311 as section 312; and (B) by inserting after section 310 the following: ‘‘§ 311. Office of Intelligence and Analysis ‘‘(a) ESTABLISHMENT.—There is established within the Department of the Treasury, the Office of Intelligence and Analysis (in this section referred to as the ‘Office’), which shall— ‘‘(1) be responsible for the receipt, analysis, collation, and dissemination of foreign intelligence and foreign counterintelligence information (within the meaning of section 3 of the National Security Act of 1947 (50 U.S.C. 401a)) related to the operation and responsibilities of the Department of the Treasury; and ‘‘(2) have such other related duties and authorities as may be assigned to it by the Secretary, subject to the authority, direction, and control of the Secretary. ‘‘(b) ASSISTANT SECRETARY FOR INTELLIGENCE AND ANALYSIS.— The Office shall be headed by an Assistant Secretary, who shall be appointed by the President, by and with the advice and consent of the Senate. The Assistant Secretary shall report directly to the Undersecretary of the Treasury for Enforcement.’’. (2) The table of sections at the beginning of chapter 3 of such title is amended by striking the item relating to section 311 and inserting the following new items:

‘‘311. Office of Intelligence and Analysis. ‘‘312. Continuing in office.’’.

(b) CONSTRUCTION OF AUTHORITY.—Nothing in section 311 of title 31, United States Code (as amended by subsection (a)), shall be construed to alter the authorities and responsibilities of the Director of Central Intelligence with respect to the Office of Intelligence and Analysis of the Department of the Treasury as an element of the intelligence community. (c) CONSULTATION WITH DCI IN APPOINTMENT OF ASSISTANT SECRETARY.—Section 106(b)(2) of the National Security Act of 1947 (50 U.S.C. 403–6(b)(2)) is amended by adding at the end the following: ‘‘(E) The Assistant Secretary for Intelligence and Analysis of the Department of the Treasury.’’. (d) CONFORMING AMENDMENTS.— (1) NATIONAL SECURITY ACT.—Section 3(4) of the National Security Act of 1947 (50 U.S.C. 401a(4)) is amended— (A) in subparagraph (H), by striking ‘‘the Department of the Treasury,’’; (B) by redesignating subparagraphs (J) and (K) as subparagraphs (K) and (L), respectively; and (C) by inserting after subparagraph (I) the following new subparagraph (J): ‘‘(J) the Office of Intelligence and Analysis of the Department of the Treasury;’’. (2) TITLE 31.—Section 301(e) of title 31, United States Code, is amended by striking ‘‘7’’ and inserting ‘‘8’’.
