Civilian passengers and commercial cargoes: transportation on Department of Defense ves sels’’; (B) by striking ‘‘(1) on vessels’’ and all that follows through ‘‘Department of the Army’’; (C) by striking ‘‘any transport agency of’’; and (D) by striking ‘‘Secretary of the Army’’ and all that follows through ‘‘be transported’’ and inserting ‘‘Secretary of Defense, be transported’’. (3) Section 2650 of such title, as transferred and redesignated by subsection (a), is amended— (A) in the matter preceding paragraph (1), by striking ‘‘Army transport agencies’’ and all that follows through ‘‘mili tary transport agency of’’; (B) in paragraph (1), by striking ‘‘Secretary of the Army’’ and inserting ‘‘Secretary of Defense’’; and (C) in paragraph (4), by striking ‘‘by air—’’ and all that follows through ‘‘the transportation cannot’’ and inserting ‘‘by air, the transportation cannot’’. (4) Section 2651 of such title, as transferred and redesignated by subsection (a), is amended by striking ‘‘Army transport agencies’’ and all that follows and inserting ‘‘the Department of Defense, under regulations and at rates to be prescribed by the Secretary of Defense.’’. (c) REPEAL OF SUPERSEDED AND OBSOLETE PROVISIONS.—The following sections of such title are repealed: sections 4741, 4743, 9741, 9743, and 9746. (d) CLERICAL AMENDMENTS.— (1) The table of sections at the beginning of chapter 157 of such title is amended by adding at the end the following new items: ‘‘2648. Persons and supplies: sea transportation. ‘‘2649. Civilian passengers and commercial cargoes: transportation on Department of Defense vessels. ‘‘2650. Civilian personnel in Alaska. ‘‘2651. Passengers and merchandise to Guam: sea transport.’’. (2) The table of sections at the beginning of chapter 447 of such title is amended by striking the items relating to sections 4741, 4743, 4744, 4745, 4746, and 4747. (3) The table of sections at the beginning of chapter 947 of such title is amended by striking the items relating to sections 9741, 9743, and 9746. SEC. 1073. EVALUATION OF PROCUREMENT PRACTICES RELATING TO TRANSPORTATION OF SECURITY SENSITIVE CARGO. (a) EVALUATION REQUIREMENT.—The Secretary of Defense shall evaluate the procurement practices of the Department of Defense in the award of service contracts for domestic freight transportation for security sensitive cargo (such as arms, ammunitions, explosives, and classified material) to determine whether such practices are in the best interests of the Department of Defense. (b) REPORT.—Not later than January 1, 2005, the Secretary of Defense shall submit to the Committees on Armed Services of the House of Representatives and the Senate a report on the results of the evaluation conducted under subsection (a).
