118 STAT. 2848 PUBLIC LAW 108–447—DEC. 8, 2004 Climate Housing Research Center in Fairbanks, Alaska; and the University of Alaska Fairbanks Allied Health Learning Center skill labs/classrooms shall be eligible to receive Commu nity Facilities grants in amounts that are equal to not more than 75 percent of the total facility costs: Provided, That for the purposes of this paragraph, the Cold Climate Housing Research Center is designated an ‘‘essential community facility’’ for rural Alaska; (3) the Secretary shall consider the City of Guymon, Okla homa; the City of Shawnee, Oklahoma; the Village of New Miami, Ohio; the City of Vicksburg, Mississippi; and the City of Altus, Oklahoma, to be eligible for loans and grants provided through the Rural Housing Insurance Fund until receipt of the decennial Census in the year 2010; (4) grants made under section 306(a)(19) of the Consoli dated Farm and Rural Development Act (7 U.S.C. 1926(a)(19)) using funds made available under this Act for the cities of Ellisville and Waynesboro, Mississippi, shall be made without a non Federal cost share requirement; (5) the City of Great Falls, Montana, shall be considered a rural area for purposes of eligibility for business and industry guaranteed loans under section 310B(a)(1) of the Consolidated Farm and Rural Development Act (7 U.S.C. 1932(a)(1)) until receipt of the decennial Census in the year 2010; (6) the Secretary may consider the Piedmont Municipal Power Agency of South Carolina eligible to participate in pro grams administered by the Rural Utilities Service until receipt of the decennial Census in the year 2010; and (7) until receipt of the decennial Census for the year 2010, for all activities under programs of the Rural Development Mission Area within the County of Honolulu, Hawaii, the Sec retary may designate any portion of the county as a rural area or eligible rural community that the Secretary determines is not urban in character: Provided, That the Secretary shall not include in any such rural area or eligible rural community any area included in the Honolulu Census Designated Place as determined by the Secretary of Commerce. SEC. 769. Section 501 of the Agricultural Trade Development and Assistance Act of 1954 (7 U.S.C. 1737) is amended— (1) in subsection (b)(1), by inserting ‘‘and Doug Bereuter’’ after ‘‘John Ogonowski’’; and (2) in the heading, by inserting ‘‘AND DOUG BEREUTER’’ after ‘‘JOHN OGONOWSKI’’. SEC. 770. Notwithstanding the provisions of the Consolidated Farm and Rural Development Act (including the associated regula tions) governing the Community Facilities Program, the Secretary may allow all Community Facility Program facility borrowers and grantees to enter into contracts with not for profit third parties for services consistent with the requirements of the Program, grant, and/or loan: Provided, That the contracts protect the interests of the Government regarding cost, liability, maintenance, and adminis trative fees. SEC. 771. Notwithstanding any other provision of law, the Secretary of Agriculture is authorized to make funding and other assistance available through the emergency watershed protection program under section 403 of the Agricultural Credit Act of 1978 (16 U.S.C. 2203) to repair and prevent damage to non Federal Contracts.
