118 STAT. 3764 PUBLIC LAW 108–458—DEC. 17, 2004 ‘‘(j) EXCEPTION.—No person may be prosecuted under this sec- tion in connection with the term ‘personnel’, ‘training’, or ‘expert advice or assistance’ if the provision of that material support or resources to a foreign terrorist organization was approved by the Secretary of State with the concurrence of the Attorney General. The Secretary of State may not approve the provision of any mate- rial support that may be used to carry out terrorist activity (as defined in section 212(a)(3)(B)(iii) of the Immigration and Nation- ality Act).’’. (g) SUNSET PROVISION.— (1) IN GENERAL.—Except as provided in paragraph (2), this section and the amendments made by this section shall cease to be effective on December 31, 2006. (2) EXCEPTION.—This section and the amendments made by this section shall continue in effect with respect to any particular offense that— (A) is prohibited by this section or amendments made by this section; and (B) began or occurred before December 31, 2006. SEC. 6604. FINANCING OF TERRORISM. (a) FINANCING TERRORISM.—Section 2339c(c)(2) of title 18, United States Code, is amended— (1) by striking ‘‘, resources, or funds’’ and inserting ‘‘or resources, or any funds or proceeds of such funds’’; (2) in subparagraph (A), by striking ‘‘were provided’’ and inserting ‘‘are to be provided, or knowing that the support or resources were provided,’’; and (3) in subparagraph (B)— (A) by striking ‘‘or any proceeds of such funds’’; and (B) by striking ‘‘were provided or collected’’ and inserting ‘‘are to be provided or collected, or knowing that the funds were provided or collected,’’. (b) DEFINITIONS.—Section 2339c(e) of title 18, United States Code, is amended— (1) by striking ‘‘and’’ at the end of paragraph (12); (2) by redesignating paragraph (13) as paragraph (14); and (3) by inserting after paragraph (12) the following: ‘‘(13) the term ‘material support or resources’ has the same meaning given that term in section 2339B(g)(4) of this title; and’’. Subtitle H—Stop Terrorist and Military Hoaxes Act of 2004 SEC. 6701. SHORT TITLE. This subtitle may be cited as the ‘‘Stop Terrorist and Military Hoaxes Act of 2004’’. SEC. 6702. HOAXES AND RECOVERY COSTS. (a) PROHIBITION ON HOAXES.—Chapter 47 of title 18, United States Code, is amended by inserting after section 1037 the fol- lowing: 18 USC 1 note.
