SEC. 1156. AMENDED DEFINITIONS FOR PURPOSES OF OMNIBUS CRIME CONTROL AND SAFE STREETS ACT OF 1968.
Section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3791) is amended as follows: (1) INDIAN TRIBE.—Subsection (a)(3)(C) of such section is amended by striking ‘‘(as that term is defined in section 103 of the Juvenile Justice and Delinquency Prevention Act of 1974 (42 U.S.C. 5603))’’. (2) COMBINATION.—Subsection (a)(5) of such section is amended by striking ‘‘program or project’’ and inserting ‘‘program, plan, or project’’. (3) NEIGHBORHOOD OR COMMUNITY-BASED ORGANIZATIONS.—Subsection (a)(11) of such section is amended by striking ‘‘which’’ and inserting ‘‘, including faith-based, that’’. (4) INDIAN TRIBE; PRIVATE PERSON.—Subsection (a) of such section is further amended— (A) in paragraph (24) by striking ‘‘and’’ at the end; (B) in paragraph (25) by striking the period at the end and inserting a semicolon; and (C) by adding at the end the following new paragraphs: ‘‘(26) the term ‘Indian Tribe’ has the meaning given the term ‘Indian tribe’ in section 4(e) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450b(e)); and ‘‘(27) the term ‘private person’ means any individual (including an individual acting in his official capacity) and any private partnership, corporation, association, organization, or entity (or any combination thereof).’’. SEC. 1157. CLARIFICATION OF AUTHORITY TO PAY SUBSISTENCE PAYMENTS TO PRISONERS FOR HEALTH CARE ITEMS AND SERVICES.
Section 4006 of title 18, United States Code, is amended— (1) in subsection (a) by inserting after ‘‘The Attorney General’’ the following: ‘‘or the Secretary of Homeland Security, as applicable,’’; and (2) in subsection (b)(1)— (A) by striking ‘‘the Immigration and Naturalization Service’’ and inserting ‘‘the Department of Homeland Security’’; (B) by striking ‘‘shall not exceed the lesser of the amount’’ and inserting ‘‘shall be the amount billed, not to exceed the amount’’; (C) by striking ‘‘items and services’’ and all that follows through ‘‘the Medicare program’’ and inserting ‘‘items and services under the Medicare program’’; and (D) by striking ‘‘; or’’ and all that follows through the period at the end and inserting a period. SEC. 1158. OFFICE OF AUDIT, ASSESSMENT, AND MANAGEMENT.
(a) IN GENERAL.—Part A of title I of the Omnibus Crime Control and Safe Streets Act of 1968 is amended by adding after section 104, as added by section 211 of this Act, the following new section: 42 USC 3712d.
