12 2 STA T . 111 7PUBLIC LA W 11 0– 2 34—M A Y 22 , 200 8to t hevalu eo f the ove ris sua nc e cause dby the syste m ic error .‘ ‘ ( iv )ADMIN I STRA TI VE AND JU DI C IA L REVIE W . — Administrative and j udicial revie w, as p rovided in sec - tion 14 , shall apply to the final determinations by the S ecretary under clause (ii). ‘‘(v) R EMISSI O NTOT H E SECRETAR Y .— ‘‘( I ) D ETERMINATION NOT A P PEALED.—If the determination of the Secretary under clause (ii) is not appealed, the State a g ency shall, as soon as practicable, remit to the Secretary the dollar amount specified in the claim under clause (iii). ‘‘(II) DETERMINATION APPEALED.—If the deter- mination of the Secretary under clause (ii) is appealed, upon completion of administrative and judicial review under clause (iv), and a finding of liability on the part of the State, the appealing State agency shall, as soon as practicable, remit to the Secretary a dollar amount subject to the finding made in the administrative and judicial review. ‘‘(vi) ALTERNATIVE METHOD O F COLLECTION.— ‘‘(I) IN G ENERAL.—If a State agency fails to ma k e a payment under clause (v) within a reason- able period of time, as determined by the Sec- retary, the Secretary may reduce any amount due to the State agency under any other provision of this Act by the amount due. ‘‘(II) ACCRUAL OF INTEREST.—During the period of time determined by the Secretary to be reasonable under subclause (I), interest in the amount owed shall not accrue. ‘‘(vii) L IMITATION.—Any liability amount estab- lished under section 1 6 (c)(1)( C ) shall be reduced by the amount of the claim established under this subparagraph. ’ ’. PARTV—MISCEL LA N E OU S SEC.41 41. PILOT P R O J ECTS TO E VA L U ATE H EALTH A ND NUTRITION PRO M OTION IN THE SUPPLEMENTAL NUTRITION ASSIST - ANCE PRO G RAM. Section 1 7 of the F ood and N utrition Act of 20 0 8 (7 U .S.C. 2026) is amended by adding at the end the following

‘‘(k) P ILOT PROJECTS TO E VALUATE H EALTH AND NUTRITION PROMOTION IN THE SUPPLEMENTAL NUTRITION ASSISTANCE PRO- GRAM.— ‘‘(1) IN GENERAL.— T he Secretary shall carry out, under such terms and conditions as the Secretary considers to be appropriate, pilot projects to develop and test methods— ‘‘(A) of using the supplemental nutrition assistance program to improve the dietary and health status of house- holds eligible for or participating in the supplemental nutri- tion assistance program

and ‘‘( B ) to reduce overweight, obesity (including childhood obesity), and associated co-morbidities in the United States. ‘‘(2) G RANTS.— Ap p licab ili ty.
