(a)INGE NE RAL.—TheS e cr e t ar ys ha l l m a k ec o m p et i ti v e g ra n ts to eligi b le entities to carry o u tasee d distribution program to administer and maintain the distribution o f vegetable seeds donated by commercial seed companies. (b) PU R POS ES.—The purposes of this program include— ( 1 ) the distribution of seeds donated by commercial seed companies free - of-charge to appropriate— ( A ) individuals

( B ) groups; ( C ) institutions; ( D ) governmental and nongovernmental organi z ations; and ( E ) such other entities as the Secretary may designate; ( 2 ) distribution of seeds to underserved communities , such as communities that e x perience— (A) limited access to affordable fresh vegetables; (B) a high rate of hunger or food insecurity; or (C) severe or persistent poverty. (c) A DMI NIS T RATION.—Paragraphs ( 4 ),( 7 ),( 8 ), and (11)(B) of subsection (b) of the Competitive, Special, and F acilities R esearch Grant Act (7 U .S.C. 4 50 i) shall apply w ith respect to the making of grants under this section. (d) SELE C TION.—An eligible entity selected to receive a grant under subsection (a) shall have— (1) expertise regarding the distribution of vegetable seeds donated by commercial seed companies; and (2) the ability to achieve the purpose of the seed distribu- tion program. (e) AUT H ORI Z ATION O F APPROPRIATIONS.—There are authorized to be appropriated such sums as are necessary to carry out this section for each of fiscal years 2008 through 2012. SEC. 752 4 . L I V E VIRUS F OOT A ND M OUT H DISEASE RESEARCH. (a) IN GENERAL.—The Secretary shall issue a permit re q uired under section 12 of the Act of M ay2 9 , 1884 (21 U.S.C. 11 3 a) to the Secretary of H omeland Security for work on the live virus of foot and mouth disease at any facility that is a successor to the Plum Island Animal Disease Center and charged with researching high-consequence biological threats involving zoonotic and foreign animal diseases (referred to in this section as the ‘ ‘successor facility ’ ’). (b) L IMITATION TO SIN G LE FACILIT Y .— N ot more than 1 facility shall be issued a permit under subsection (a). (c) LIMITATION ON V ALIDITY.—The permit issued under this section shall be valid unless the Secretary determines that the study of live foot and mouth disease virus at the successor facility is not being carried out in accordance with the regulations promul- gated by the Secretary pursuant to the Agricultural Bioterrorism Protection Act of 2002 (7 U.S.C. 8401 et seq.). (d) AUTHORITY.—The suspension, revocation, or other impair- ment of the permit issued under this section— (1) shall be made by the Secretary; and (2) is a nondelegable function. 21USC 11 3anote.P e rmi t s .
