12 2 STA T . 2 05 2 PUBLIC LA W 110 – 2 46—J U NE 1 8, 2008 ‘ ‘ (1)EMERG E NCY ME ASU RES .—Thet e rm ‘emer g e ncy me as-u res ’ means th o se measures that— ‘‘( A ) are necessary to a d dress damage caused b ya natura l d i saster to natural resources on nonindustrial p ri- v ate f orest land , and the damage, if not treated— ‘‘(i) w ould impair or endanger the natural resources on the land
and ‘‘(ii) would materially affect future use of the land; and ‘‘( B ) would restore forest health and forest-related resources on the land. ‘‘( 2 ) N A T URA LDI SASTER.—The term ‘natural disaster’ includes wildfires, hurricanes or e x cessive winds, drought, ice storms or bli z zards, floods, or other resource-impacting events, as determined by the S ecretary. ‘‘( 3 )N O NINDUSTRIAL P RI V ATE F OREST LAND.—The term ‘non- industrial private forest land’ means rural land, as determined by the Secretary, that— ‘‘(A) has existing tree cover (or had tree cover imme- diately before the natural disaster and is suitable for growing trees); and ‘‘(B) is owned by any nonindustrial private individual, group, association, corporation, or other private legal entity, that has definitive decision-ma k ing authority over the land. ‘‘( 4 ) SECRETARY.—The term ‘Secretary’ means the Secretary of Agriculture. ‘‘(b) AVAILA B ILITY OF ASSISTANCE.—The Secretary may make payments to an owner of nonindustrial private forest land who carries out emergency measures to restore the land after the land is damaged by a natural disaster. ‘‘(c) ELIGIBILITY.—To be eligible to receive a payment under subsection (b), an owner must demonstrate to the satisfaction of the Secretary that the nonindustrial private forest land on which the emergency measures are carried out had tree cover immediately before the natural disaster. ‘‘(d) C OST S H ARE R E Q UIREMENT.— P ayments made under sub- section (b) shall not exceed 75 percent of the total cost of the emergency measures carried out by an owner of nonindustrial pri- vate forest land. ‘‘(e) AUTHORI Z ATION OF APPROPRIATIONS.—There are authorized to be appropriated to the Secretary such funds as may be necessary to carry out this section. Amounts so appropriated shall remain available until expended.’’. (b) REGULATIONS.—Not later than one year after the date of the enactment of this Act, the Secretary of Agriculture shall issue regulations to carry out section 4 0 7 of the Agricultural Credit Actof1 9 7 8 , as added by subsection (a). SEC.8204 . PR E V E NTIO NO F I L LE GA L LOGGING PRACTICES.
