C . 1 3 08) or any successor p ro v isions re l atin g to direct attribution shall apply w ith respect to assistance provided under this section. ‘‘(i) P ERIO D O FE FFECTI V ENE S S.— T his section shall be effective only for losses that are incurred as the result of a disaster , adverse weather, or other environ m ental condition that occurs on or before September 30, 2 011, as determined by the Secretary. ‘‘( j ) N ODU PL ICATIVE PA YM ENTS.— I n implementing any other program which ma k es disaster assistance payments (e x cept for indemnities made under subtitle A and section 19 6 of the Federal Agriculture Improvement and R eform Act of 1996), the Secretary shall prevent duplicative payments with respect to the same loss for which a person receives a payment under subsections (b), (c), (d), (e), or (f). ‘‘(k) APPLICATION.— ‘‘(1) IN G ENERAL.—Subject to paragraph (2) and notwith - standing any provision of subtitle A, subtitle A shall not apply to this subtitle. ‘‘(2) CROSS REFERENCES.—Paragraph (1) shall not apply to a specific reference in this subtitle to a provision of subtitle A. ’ ’. (b) TRANSITION.—For purposes of the 2008 crop year, the Sec- retary shall carry out subsections (f)(4) and (h) of section 531 of the Federal Crop Insurance Act (as added by subsection (a)) in accordance with the terms and conditions of sections 1001 through 1001D of the Food Security Act of 1985 (16 U.S.C. 1308 et se q .), as in effect on September 30, 2007. (c) CONFORMING AMENDMENTS.— (1) Section 501 of the Federal Crop Insurance Act (7 U.S.C. 1501) is amended by striking the section heading and enu- merator and inserting the following

O f the funds of the Commodity Credit Corporation, the Sec- retary of Agriculture shall transfer to the Secretary of Commerce $ 170,000,000 for fiscal year 2008 for the National M arine Fisheries Service to distribute to commercial and recreational members of the fishing communities affected by the salmon fishery failure in the States of California, Oregon, and W ashington designated under section 312(a) of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1861a(a)) on May 1, 2008, in accordance with that section. 7USC150 1 – 150 3, 1505–1510, 151 4 , 1515, 1517, 151 8 ,15 2 0–1523 .
