‘‘(e) PROTES TS. — (1) A protest is not authori z ed in connection with the issuance or proposed issuance of a task or deli v ery order e x cept for— ‘‘(A) a protest on the ground that the order increases the scope, period, or maximum value of the contract under which the order is issued; or ‘‘(B) a protest of an order valued in excess of $ 10,000,000. ‘‘( 2 ) N otwithstanding section 355 6 of title 31, U nited S tates Code, the Comptroller G eneral of the United States shall have exclusive j urisdiction of a protest authorized under paragraph (1)(B). ‘‘(3) T his subsection shall be in effect for three years, beginning on the date that is 120 days after the date of the enactment of the National D efense Authorization Act for F iscal Y ear 200 8 .’’. (3) EF FE C T IV E DA TES.— (A) SI NGL EA W ARD CONTRACTS.—The amendments made by paragraph (1) shall take effect on the date that is 120 days after the date of the enactment of this Act, and shall apply with respect to any contract awarded on or after such date. (B) O RDERS IN E X CESS OF $5 , 0 00,000.—The amendments made by paragraph (2) shall take effect on the date that is 120 days after the date of the enactment of this Act, and shall apply with respect to any task or delivery order awarded on or after such date. SEC.84 4. PUBLI C D ISCL O SU R EO FJ US T IFIC A TIO N AND APPRO V AL DOCU M ENTS FOR NONCOMPETITIVE CONTRACTS. (a) CIVILIAN AGENC Y CONTRACTS.— (1) I N GENERAL.—Section 303 of the Federal Property and Administrative Services Act of 1 94 9 (41 U.S.C. 253) is amended by adding at the end the following new subsection: ‘‘(j)(1)(A) Except as provided in subparagraph (B), in the case of a procurement permitted by subsection (c), the head of an execu- tive agency shall make publicly available, within 14 days after the award of the contract, the documents containing the justification and approval required by subsection (f)(1) with respect to the procurement. ‘‘(B) In the case of a procurement permitted by subsection (c)(2), subparagraph (A) shall be applied by substituting ‘30 days’ for ‘14 days’. ‘‘(2) The documents shall be made available on the website of the agency and through a government-wide website selected by the Administrator for Federal Procurement Policy. ‘‘(3) This subsection does not require the public availability of information that is exempt from public disclosure under section 552(b) of title 5, United States Code.’’. (2) CONFOR M ING AMENDMENT.—Section 303(f) of such Act is amended— (A) by striking paragraph (4); and (B) by redesignating paragraph (5) as paragraph (4).
