SEC.104 . PROT ECT I O N O F ST UD ENT SPEEC HA ND ASSOCIATION RI G HTS. Section 112 (20 U.S.C. 1011a) is amended — (1) in subsection (a)— (A) by inserting ‘‘(1)’’ before ‘‘ I t is the sense’’; and ( B ) by adding at the end the fo l lo w ing

‘‘(2) It is the sense of Congress that— ‘‘(A) the diversity of institutions and educational missions is one of the key strengths of American higher education; ‘‘(B) individual institutions of higher education have dif- ferent missions and each institution should design its academic program in accordance with its educational goals; ‘‘(C) an institution of higher education should facilitate the free and open e x change of ideas; ‘‘( D ) students should not be intimidated, harassed, discour- aged from speaking out, or discriminated against; ‘‘(E) students should be treated e q ually and fairly; and ‘‘( F ) nothing in this paragraph shall be construed to modify, change, or infringe upon any constitutionally protected religious liberty, freedom, expression, or association.’’; and (2) in subsection (b)(1), by inserting ‘‘, provided that the imposition of such sanction is done ob j ectively and fairly’’ after ‘‘higher education’’. SEC. 10 5 . TREAT M ENT OF TERRITORIES AND TERRITORIA L STUDENT ASSISTANCE. Section 113 (20 U.S.C. 1011b) is amended— (1) by striking ‘‘ TREA T M E N T OF TERR I TORIE S AN D TERRI - TORIA L ST U DENT ASSISTAN C E’’ in the heading of such section and inserting ‘‘TERRITORIAL W AI V ER AUT H ORIT Y ’’; (2) by striking ‘‘(a) W AIVER A UTHO RIT Y .—’’; and (3) by striking subsection (b). SEC. 10 6 . NATIONAL AD V ISOR Y COMMITTEE ON INSTITUTIONAL Q UALITY AND INTEGRITY. (a) A M E ND MENT.—Section 114 (20 U.S.C. 1011c) is amended to read as follows:
