C ustoms and B order P rotection requirements and aircraft that have been damaged beyond repair, shall be trans- ferred to any other Federal agency, department, or office outside of the D epartment of Homeland Security during fiscal year 200 9 without the prior approval of the Committees on A ppropriations of the Senate and the House of Representatives: Provided fu r th er , That of the total amount made available under this heading, $18,000,000 shall not be obligated until the Secretary notifies the Committees on Appropriations of the Senate and House of Rep- resentatives that the Department of Homeland Security has imple- mented the concept of operations described in section 5 4 4 of this Act. CONSTRU CT I ON For necessary expenses to plan, construct, renovate, equip, and maintain buildings and facilities necessary for the administra- tion and enforcement of the laws relating to customs and immigra- tion, $40 3 ,201,000, to remain available until expended, of which $39, 7 00,000 shall be for the Advanced Training Center: Provided, That for fiscal year 2010 and thereafter, the annual budget submis- sion of U.S. Customs and Border Protection for ‘ ‘Construction ’ ’ shall, in consultation with the G eneral Services Administration, include a detailed 5-year plan for all Federal land border port of entry pro j ects with a yearly update of total projected future funding needs. U.S. IM MI G R A TION AN D CUSTOMS E N F ORC E MENT SA L ARIES AND E XP ENSES For necessary expenses for enforcement of immigration and customs laws, detention and removals, and investigations; and pur- chase and lease of up to 3,790 ( 2,350 for replacement only ) police- type vehicles; $4,927,210,000, of which not to exceed $7,500,000 shall be available until expended for conducting special operations under section 3131 of the Customs Enforcement Act of 1986 (19 U.S.C. 2081); of which not to exceed $15,000 shall be for official reception and representation expenses; of which not to exceed $1,000,000 shall be for awards of compensation to informants, to be accounted for solely under the certificate of the Secretary of Homeland Security; of which not less than $305,000 shall be for promotion of public awareness of the child pornography tipline and anti-child exploitation activities; of which not less than $5,400,000 shall be used to facilitate agreements consistent with section 287(g) of the Immigration and N ationality Act (8 U.S.C. 1357(g)); and of which not to exceed $11,216,000 shall be available to fund or reimburse other Federal agencies for the costs associated with the care, maintenance, and repatriation of smuggled aliens unlawfully present in the United States: Provided, That none of Waiver a utho rit y.Pl a n . 6USC214 note.
