12 2 STA T .4 2 0 1 PUBLIC LA W 110 –39 2 —O CT. 13 , 200 8‘ ‘ (D)AL L OCATI O N O F F U N DS.— ‘‘( i ) REQ UI R E M ENT OF FORMULA.— Oftheamoun t s a p p r opriate d under su b para g raph (A) , not reser v ed under subparagraph ( B ),anda l lo c ated b y the S ecretary for grants under subsection (a), the Secretary shall distribute a portion of such amounts to grantees under subsection (a) on the basis of a formula. ‘‘(ii) RELE V ANT FACTORS.— T he formula developed by the Secretary under clause (i) shall ta k e into account the level of tuberculosis morbidity and case comple x ity in the respective geographic area and may consider other factors relevant to tuberculosis in such area. ‘‘(iii) N OC H AN G E TO FORMULA REQUIRED.—This subparagraph does not re q uire the Secretary to modify the formula that w as used by the Secretary to dis - tribute funds to grantees under subsection (a) for fiscal year 20 0 9 . ‘‘(2) L IMITATION.—The authori z ation of appropriations established in paragraph ( 1 ) for a fiscal year is effective only if the amount appropriated under such paragraph for such year equals or exceeds the amount appropriated to carry out this section for fiscal year 2009. ’ ’. TI T LE II —NA TI O NAL IN S TIT U TES O FH EALTH SEC.201 . R ESE A RC H A ND DE V E LOPM EN T CONCERN I N G T UB ER - CULOSIS. Subpart 2 of part C of title IV of the P ublic H ealth Service Act ( 4 2 U .S.C. 2 85 b et seq.) is amended by inserting after section 424B the following section

‘SEC. 4 24C. TUBERCULOSIS. ‘‘(a) IN G ENERAL.—The Director of the National Institutes of Health may expand, intensify, and coordinate research and develop- ment and related activities of the Institutes with respect to tuber- culosis including activities toward the goal of eliminating such disease. ‘‘(b) CERTAIN ACTIVITIES.—Activities under subsection (a) may include— ‘‘(1) enhancing basic and clinical research on tuberculosis, including drug resistant tuberculosis

‘‘(2) expanding research on the relationship between such disease and the human immunodeficiency virus; and ‘‘( 3 ) developing new tools for the elimination of tuberculosis, including public health interventions and methods to enhance 42USC 2 85b–7c.
