12 2 STA T .43 11 PUBLIC LA W 11 0– 40 9—O CT. 14 , 200 8‘ ‘ (A)STAND A R D S A P P LIC A B L E.—Investiga ti o ns initiate du nde r t h is su b se c tion sha l l be conducted in accordance w ith the m ost current Q ualit y Standards f or Investigations issued by the C ouncil or by its p redecessors (the P resident ’ s Council on Integrity and E fficiency and the E x ecutive Council on Integrity and Efficiency). ‘‘( B ) ADDITI O NAL POLICIES AND PROCED U RES.— ‘‘(i) ESTABLIS HM ENT.— T he Integrity Committee , in con j unction with the Chairperson of the Council, shall establish additional policies and procedures necessary to ensure fairness and consistency in— ‘‘(I) determining whether to initiate an inves - tigation
‘‘(II) conducting investigations; ‘‘(III) reporting the results of an investigation; and ‘‘(I V ) providing the person who is the subject of an investigation with an opportunity to respond to any Integrity Committee report. ‘‘(ii) SUBMISSION TO CON G RESS.—The Council shall submit a copy of the policies and procedures estab- lished under clause (i) to the congressional committees of jurisdiction. ‘‘(C) R EPORTS.— ‘‘(i) POTENTIALL Y MERITORIOUS ALLEGATIONS.— F or allegations described under paragraph ( 5 )(C), the Chairperson of the Integrity Committee shall ma k e a report containing the results of the investigation of the Chairperson and shall provide such report to members of the Integrity Committee. ‘‘(ii) ALLEGATIONS O FW RONGDOING.—For allega- tions referred to an agency under paragraph (5)(B), the head of that agency shall make a report containing the results of the investigation and shall provide such report to members of the Integrity Committee. ‘‘( 8 ) ASSESSMENT AND FINAL DISPOSITION.— ‘‘(A) IN GENERAL.— W ith respect to any report received under paragraph ( 7 )(C), the Integrity Committee shall— ‘‘(i) assess the report; ‘‘(ii) forward the report, with the recommendations of the Integrity Committee, including those on discipli- nary action, within 30 days (to the maximum extent practicable) after the completion of the investigation, to the Executive Chairperson of the Council and to the President (in the case of a report relating to an Inspector G eneral of an establishment or any employee of that Inspector General) or the head of a designated Federal entity (in the case of a report relating to an Inspector General of such an entity or any employee of that Inspector General) for resolution; and ‘‘(iii) submit to the Committee on Government O versight and Reform of the H ouse of Representatives, the Committee on Homeland Security and Govern- mental Affairs of the Senate, and other congressional committees of jurisdiction an executive summary of such report and recommendations within 30 days after Executiv e s u m m ary.D ea dl i n e.
