(c) R ESTRIC TI ON ON OBL I GA TION O FFU N D S P ENDING NOTIFICA - TION. — Of the amounts appropriated pursuant to an authori z ation of appropriations in this A ct or other w ise made a v ailable for research, development, test, and evaluation, Army, for fiscal year 200 9 for the WIN–T Increment 3 program, not more than 50 percent of those amounts may be obligated or e x pended until 1 5 days after the date on which the notification required by subsection (a) is received by the congressional defense committees. SEC.216 . LIM I TA TI ON ON SO UR CEO F FUN D S FOR CERTAIN J OINT CAR G O AIRCRAFT E XP ENDITURES. (a) L I M ITATION.—Of the amounts appropriated pursuant to an authorization of appropriations in this Act or otherwise made avail- able for fiscal year 2009 or any fiscal year thereafter for the Army or the Air Force, the Secretary of the Army and the Secretary of the Air Force may fund relevant expenditures for the Joint Cargo Aircraft only through amounts made available for procure- ment or for research, development, test, and evaluation. (b) RELE V ANT E XP ENDITURES FOR T H E JOINT CARGO AIRCRAFT DEFINED.—In this section, the term ‘ ‘relevant expenditures for the Joint Cargo Aircraft ’ ’ means expenditures relating to— (1) support equipment

(2) initial spares; (3) training simulators; ( 4 ) systems engineering and management; and (5) post-production modifications. SEC. 21 7 . RE Q UIREMENT FOR PLAN ON O V ER H EAD NONIMAGING INFRARED S Y STEMS. (a) IN GENERAL.—The Secretary of Defense, in consultation with the Director of National Intelligence, shall develop a com- prehensive plan to conduct and support research, development, and demonstration of technologies that could evolve into the next generation of overhead nonimaging infrared systems. (b) ELEMENTS.—The plan required by subsection (a) shall include the following

(1) The research ob j ectives to be achieved under the plan. (2) A description of the research, development, and dem- onstration activities under the plan. (3) An estimate of the duration of the research, develop- ment, and demonstration of technologies under the plan. (4) The cost and duration of any flight or on-orbit dem- onstrations of the technologies being developed. (5) A plan for implementing any acquisition programs with respect to technologies determined to be successful under the plan. ( 6 ) An identification of the date by which a decision must be made to begin any follow-on programs and a justification for the date identified. (7) A schedule for completion of a full analysis of the on-orbit performance characteristics of the Space- B ased Infrared System and the Space Trac k ing and Surveillance 10USC2 2 4 1 note.
