12 2 STA T .489PUBLIC LA W 11 0– 181 —J A N .28 , 2008 com m unity,a n dh om e-b a s ed com p onents uti l i z in g inte r disciplinary treatment teams .‘ ‘ ( b )LOCATI O N O FPR O G RA M . —T he S ecretary shall carry out the program de v eloped under subsection (a) in each D epartment polytrauma rehabilitation center designated by the Secretary. ‘‘(c) EL IGI B ILIT Y .— A veteran is eligible f or care under the pro- gram developed under subsection (a) if the veteran is other w ise eligible to receive hospital care and medical services under section 17 1 0 of this title and— ‘‘(1) served on active duty in a theater of combat operations (as determined by the Secretary in consultation with the Sec- retary of Defense) during a period of war after the Persian G ulf W ar, or in combat against a hostile force during a period of hostilities (as defined in section 171 2 A(a)(2)( B ) of this title) after N ovember 11, 1 9 9 8; ‘‘(2) is diagnosed as suffering from moderate to severe traumatic brain in j ury; and ‘‘( 3 ) is unable to manage routine activities of daily living without supervision or assistance, as determined by the Sec- retary. ‘‘(d) REP ORT.—Not later than one year after the date of the enactment of this section, and annually thereafter, the Secretary shall submit to the C ommittees on V eterans ’ Affairs of the Senate and the H ouse of Representatives a report containing the following information

‘‘(1) A description of the operation of the program. ‘‘(2) The number of veterans provided care under the pro- gram during the year preceding such report. ‘‘(3) The cost of operating the program during the year preceding such report.’’. (b) CLERICAL AMEN D MENT.—The table of sections at the begin- ning of such chapter is amended by inserting after the item relating to section 1710B the following new items: ‘ ‘ 17 1 0C.Traum a ticb rai n in j ur y:pl an sfo rr eh abilitation an d reinte g ration into the community. ‘‘1710 D . Traumatic brain injury: comprehensi v e plan for long - term rehabilitation. ’ ’. SEC.1703 . U SE OFN ON -D E PARTM ENT OF V ETERANS AFFA I RS FACI L I- TIES FOR IMPLEMENTATION OF RE H A B ILITATION AND COMMUNIT Y REINTE G RATION PLANS FOR TRAUMATIC BRAIN IN J URY. (a) I N GENERAL.—Subchapter II of chapter 17 of title 38, U nited States Code, is amended by inserting after section 1710D, as added by section 1702, the following new section: ‘ ‘ §17 1 0E.Traum a ticb rai n in j ur y: u seof non -D e p artment faci l ities for re h abilitation ‘‘(a) COOPERATI V E AGREEMENT S .—The Secretary, in imple- menting and carrying out a plan developed under section 1710C of this title, may provide hospital care and medical services through cooperative agreements with appropriate public or private entities that have established long-term neurobehavioral rehabilitation and recovery programs. ‘‘(b) A U T H ORITIES OF STATE PROTECTION AND ADVOCACY SYS- TEMS.—Nothing in subtitle C of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 shall be construed as preventing a State protection and advocacy system (as defined
