C . 2528a) is re p eale d . (b) REPORTS ON NU C LEAR T EST READINESS POSTURES.— (1) I N G ENERAL.—Section 4208 of the Ato m ic E ner gy Defense Act (50 U.S.C. 2528) is amended to read as follows

‘SEC. 4 2 08 .RE PO RTS ON NUCLEAR TEST READINESS. ‘ ‘(a) IN G ENERAL.—Not later than M arch 1 , 200 9 ,ande v ery odd - numbered year thereafter, the Secretary of Energy shall submit to the congressional defense committees a report on the nuclear test readiness of the United States. ‘‘(b) ELEMENTS.—Each report under subsection (a) shall include, current as of the date of such report, the following: ‘‘(1) An estimate of the period of time that would be nec- essary for the Secretary of Energy to conduct an underground test of a nuclear weapon once directed by the President to conduct such a test. ‘‘(2) A description of the level of test readiness that the Secretary of Energy, in consultation with the Secretary of Defense, determines to be appropriate. ‘‘(3) A list and description of the wor k force skills and capabilities that are essential to carrying out an underground nuclear test at the Nevada Test Site. ‘‘(4) A list and description of the infrastructure and physical plant that are essential to carrying out an underground nuclear test at the Nevada Test Site. ‘‘(5) An assessment of the readiness status of the skills and capabilities described in paragraph (3) and the infrastruc- ture and physical plant described in paragraph (4). ‘‘(c) FORM.—Each report under subsection (a) shall be submitted in unclassified form, but may include a classified anne x . ’ ’. (2) CLERICAL AMENDMENT.—The item relating to section 4208 in the table of contents for such Act is amended to read as follows: ‘ ‘ Sec.4208 . R e ports o n n u c l e a r test rea di ness. ’ ’. SEC. 3113. M ODI F ICATION OF REPORTIN G RE Q UIREMENT. Section 3111 of the National Defense Authorization Act for Fiscal Year 2006 (Public Law 109–163; 119 Stat. 3539) is amended— (1) by redesignating subsections (c) and (d) as (d) and (e), respectively; (2) by inserting after subsection (b) the following: ‘‘(c) FORM.—The report re q uired by subsection (b) shall be sub- mitted in classified form, and shall include a detailed unclassified summary.’’; and (3) in subsection (e), as so redesignated, by striking ‘‘(c)’’ and inserting ‘‘(d)’’. SEC. 3114. LIMITATION ON A V AILA B ILIT Y OF FUNDS FOR FISSILE MATERIALS DISPOSITION PROGRAM. (a) LIMITATION PENDING REPORT ON USE OF PRIOR FISCAL YEAR FUNDS.—No more than 75 percent of the fiscal year 2008 Fissile Materials Disposition program funds may be obligated for the Fissile Materials Disposition program until the Secretary of Energy, in consultation with the Administrator for Nuclear Security, submits 50USC2 52 8.
