12 2 STA T .796PUBLIC LA W 11 0– 229 —M A Y8, 2008 ‘ ‘ (C)ADMIN I STRA TI O N .—Subject t os ub par a g rap h ( E )( i i) , the trai l shall be a dm i n istered b y the Secretary o f the I nterior. ‘‘( D ) L AND A CQU ISITION.— N o land or interest in land outside the e x terior boundaries of any federally adminis - tered area may be ac q uired by the U nited States for the trail except w ith the consent of the owner of the land or interest in land. ‘‘(E) P U BL IC P ARTICIPATION.— T he Secretary of the Interior shall— ‘‘(i) encourage communities, owners of land along the trail, and v olunteer trail groups to participate in the planning, development, and maintenance of the trail

and ‘‘(ii) consult with other affected landowners and F ederal, State, and local agencies in the administration of the trail. ‘‘(F) INT E RPRETATION AND ASSISTANCE.—Subject to the availability of appropriations, the Secretary of the Interior may provide, to State and local governments and nonprofit organi z ations, interpretive programs and services and tech- nical assistance for use in— ‘‘(i) carrying out preservation and development of the trail; and ‘‘(ii) providing education relating to the W ar of 18 1 2 along the trail. ’ ’. SEC.342 . LAND C O N V E Y ANCE , LE WI S AND CLA RK NA T IONAL H ISTORIC TRAIL, NE B RASKA. (a) CON V E Y ANCE AUT H ORI Z ED.—The Secretary of the Interior may convey, without consideration, to the M issouri R iver B asin Lewis and Clar k Interpretive Trail and V isitor Center Foundation, Inc. (a 50 1(c)( 3 ) not-for-profit organization with operational head- quarters at 100 Valmont Drive, Nebraska City, Nebraska 6 8 4 10), all right, title, and interest of the United States in and to the federally owned land under jurisdiction of the Secretary consisting of 2 parcels as generally depicted on the map titled ‘‘Lewis and Clark National H istoric Trail’’, numbered 648 / 80,002, and dated March 2006. (b) SURVEY; CONVEYANCE COST.—The exact acreage and legal description of the land to be conveyed under subsection (a) shall be determined by a survey satisfactory to the Secretary. The cost of the survey and all other costs incurred by the Secretary to convey the land shall be borne by the Missouri River Basin Lewis and Clark Interpretive Trail and Visitor Center Foundation, Inc. (c) CONDITION O F CONVEYANCE, USE OF CONVEYED LAND.— The conveyance authorized under subsection (a) shall be subject to the condition that the Missouri River Basin Lewis and Clark Interpretive Trail and Visitor Center Foundation, Inc. use the con- veyed land as an historic site and interpretive center for the Lewis and Clark National Historic Trail. (d) DISCONTINUANCE OF USE.—If Missouri River Basin Lewis and Clark Interpretive Trail and Visitor Center Foundation, Inc. determines to discontinue use of the land conveyed under subsection (a) as an historic site and interpretive center for the Lewis and Clark National Historic Trail, the Missouri River Basin Lewis and
