and (ii) any analyses and closing costs associated with the conveyance; ( C ) for m anagement purposes, the S ecretary may recon - figure the description of the land for sale; and ( D ) the owner of the ad j acent private land shall have the first opportunity to buy the land . ( 3 )D ISPO SI T IO N O F P R O CE E D S.— ( A ) I N G ENER AL .— T he Secretary shall deposit the cash proceeds from a sale of land under paragraph ( 1 )inthe fund established under P ublic L aw 90– 1 7 1 (commonly k nown as the ‘ ‘Sisk Act ’ ’) (1 6U .S.C. 48 4a). (B) A V AILA B ILIT Y AND U SE.—Amounts deposited under subparagraph (A)— (i) shall remain available until e x pended for the ac q uisition of land for N ational F orest purposes in the State of Idaho; and (ii) shall not be subject to transfer or reprogram- ming for— (I) wildland fire management; or (II) any other emergency purposes. SEC.3 3 09 . S ANDI A PU E BLO LAND E X C H AN G E T ECHNICAL A M END - MENT. Section 413(b) of the T’uf Shur Bien Preservation Trust Area Act (16 U.S.C. 5 39m–11) is amended— (1) in paragraph (1), by inserting ‘‘3,’’ after ‘‘sections’’; and ( 2 ) in the first sentence of paragraph (4), by inserting ‘‘, as a condition of the conveyance,’’ before ‘‘remain’’. The purpose of this subtitle is to identify options that may be available to assist in maintaining the open space characteristics of land that is part of the mountain backdrop of communities in the northern section of the Front R ange area of Colorado. SEC. 340 2 .DE F INITIONS. In this subtitle

(1) SECRETARY.—The term ‘‘Secretary’’ means the Secretary of Agriculture, acting through the Chief of the Forest Service. (2) STATE.—The term ‘‘State’’ means the State of Colorado. (3) STUDY AREA.— (A) IN GENERAL.—The term ‘‘study area’’ means the land in southern Boulder, northern J efferson, and northern G ilpin Counties, Colorado, that is located west of Colorado State H ighway 93, south and east of Colorado State High- way 119, and north of Colorado State Highway 46, as generally depicted on the map entitled ‘‘Colorado Northern Front Range M ountain Backdrop Protection Study Act: Study Area’’ and dated August 27, 2008.
