( B ) reasonable costs incurred by the D istrict as a result of participation in the plannin g, design, permitting, and construction of the P roject; and ( C )theac q uisition costs of lands used or acquired by the District for the Project . ( 5 ) LIM I TA TI ON . —T he Secretary shall not provide funds for the operation or maintenance of the Project authori z ed by this subsection. The operation, ownership, and maintenance of the Project shall be the sole responsibility of the District. ( 6 )P L AN S AN D ANAL Y S E S C ONSISTENT W IT HF EDE R AL LAW.— Before obligating funds for design or construction under this subsection, the Secretary shall work cooperatively with the District to use, to the e x tent possible, plans, designs, and engineering and environmental analyses that have already been prepared by the District for the Project. The Secretary shall ensure that such information as is used is consistent with applicable F ederal laws and regulations. ( 7 ) TITLE; RES P ONSI B ILITY; LIABILITY.— N othing in this sub- section or the assistance provided under this subsection shall be construed to transfer title, responsibility, or liability related to the Project to the U nited States. ( 8 )A U THORI Z ATION OF APPROPRIATION.—There is author- ized to be appropriated to the Secretary to carry out this subsection $2 2,5 0 0,000 or 25 percent of the total cost of the Project, whichever is less. (e) SUNSET.—The authority of the Secretary to carry out any provisions of this section shall terminate 1 0 years after the date of the enactment of this Act. SEC.9103 .E A S T E RN NE WM E XI C O R U RA L WATER S Y STEM P RO J ECT , NEW MEXICO. (a) DEFINITIONS.— I n this section

(1) AUTHORITY.—The term ‘ ‘Authority ’ ’ means the E astern New M exico R ural W ater Authority, an entity formed under State law for the purposes of planning, financing, developing, and operating the System. (2) EN G INEERING REPORT.—The term ‘‘engineering report’’ means the report entitled ‘‘Eastern New Mexico Rural Water System Preliminary Engineering Report’’ and dated O ctober 2006. ( 3 ) PLAN.—The term ‘‘plan’’ means the operation, mainte- nance, and replacement plan required by subsection (c)(2). ( 4 ) SECRETARY.—The term ‘‘Secretary’’ means the Secretary of the Interior. (5) STATE.—The term ‘‘State’’ means the State of New Mexico. (6) SYSTEM.— (A) IN GENERAL.—The term ‘‘System’’ means the Eastern New Mexico Rural Water System, a water delivery project designed to deliver approximately 16,500 acre-feet of water per year from the Ute Reservoir to the cities of Clovis, Elida, G rady, Melrose, Portales, and Texico and other locations in Curry, Roosevelt, and Q uay Counties in the State.
