‘‘( B )e x cept as provided in su b paragraph ( C ), may pro - vide for such share through F ederal, S tate, or local sources, including private funds or donated services; and ‘‘(C) may not provide for such share through Federal funds made available under title I of the E lementary and Secondary Education Act of 1965 ( 20U. S.C. 6 3 11 et seq.) or the Individuals w ith D isabilities Education Act (20 U.S.C. 1 4 00 et seq.). ‘‘(b) WAIVER . —T he Chief Executive O fficer may waive the requirements of subsection (a) in whole or in part with respect to any such program for any fiscal year, on a determination that such a waiver would be equitable due to a lack of resources at the local level. ‘ ‘ SEC.1 1 7 . LIM I TA TI ON SON U SES O F FUN D S. ‘‘ N ot more than 6 percent of the amount of assistance received by a State, territory, or Indian tribe that is the original recipient of an allotment under this part for a fiscal year may be used to pay, in accordance with such standards as the Corporation may issue, for administrative costs, incurred by that recipient. ’ ’. SEC. 1 20 2. H I G HE R EDUCATION P RO V ISIONS. (a) R E D E S I GN A T I O N.—Section 119 (42 U.S.C. 12561) is redesig- nated as section 11 8 . (b) H IG H ER ED UC ATION INNOVATIVE P ROGRA M S.—Section 118 (as so redesignated) is amended— (1) in subsection (a), by inserting after ‘‘community service programs’’ the following

‘‘through service-learning’’; (2) in subsection (b)— (A) in the matter preceding paragraph (1), by striking ‘‘combination’’ and inserting ‘‘consortium’’; (B) in paragraph (1)— (i) in subparagraph (A), by striking ‘‘and’’ at the end; (ii) in subparagraph (B), by adding ‘‘and’’ at the end; and (iii) by adding at the end the following: ‘‘(C) the institution or partnership may coordinate with service-learning curricula being offered in the academic curricula at the institution of higher education or at 1 or more members of the partnership;’’; and (C) in paragraph (3)— (i) in the matter preceding subparagraph (A), by striking ‘‘teachers at the elementary, secondary, and postsecondary levels’’ and inserting ‘‘institutions of higher education and their faculty’’; (ii) in subparagraph (A), by striking ‘‘education of the institution; and’’ and inserting ‘‘curricula of the institution to strengthen the instructional capacity of teachers to provide service-learning at the elementary and secondary levels;’’; (iii) by redesignating subparagraph (B) as subpara- graph (C); and (iv) by inserting after subparagraph (A) the fol- lowing: 42USC1 2 5 2 9.
