U nless other w ise pro v ided for in this joint resolution or in the applicable appropriations A ct, appropriations and funds m ade available and authority granted pursuant to sections 15 7 through 161 of this joint resolution shall be available until (1) enactment into law of an Act to e x tend or reauthori z e surface transportation programs, or (2) the date specified in section 106(3) of this joint resolution, whichever first occurs, and shall be charged to the applicable appropriation, fund, or authorization whenever a bill in which such applicable appropriation, fund, or authorization is contained is enacted into law. SEC. 163. N one of the funds made available by this joint resolu - tion or any prior Act may be provided to the Association of Commu- nity Organizations for R eform Now (ACORN), or any of its affiliates, subsidiaries, or allied organizations. SEC. 164. (a) Clause (iii) of section 8 909a(d)(3)(A) of title 5, United States Code, is amended to read as follows

‘‘(iii) $ 1,400,000,000, not later than September 30, 2009

’’. (b) T he amendment made by subsection (a) shall ta k e effect as if included in the enactment of section 803(a)(1)( B ) of the Postal Accountability and E nhancement Act (Public L aw 109 – 435; 120 Stat. 3251).
