(a) A MEND MEN TS . — Section 1111 of the Duncan H unter National Defense Authorization Act for Fiscal Year 200 9 (Public Law 110– 417; 122 Stat. 4 6 19)isa m en d ed— (1) in subsection (b) , b y stri k in g‘ ‘for four ’ ’; (2) in paragraph (1) of subsection (b), by striking ‘‘re q uire - ments of—’’ and all that follows through the end of subpara- graph (C) and inserting ‘‘the requirements of section 115b of this title; or’’; (3) in paragraph (2) of subsection (b), by striking ‘‘purpose described in paragraphs (1) through (4) of subsection (c).’’ and inserting the following

‘‘any of the following purposes: ‘‘(A) Performance of inherently go v ernmental functions. ‘‘( B ) Performance of work pursuant to section 2463 of title 10, United States Code. ‘‘(C) Ability to maintain sufficient organic e x pertise and technical capability. ‘‘(D) Performance of work that, while the position may not exercise an inherently governmental function, neverthe- less should be performed only by officers or employees of the Federal G overnment or members of the Armed Forces because of the critical nature of the work.’’; and (4) by striking subsections (c) and (d). (b) C O NSO LI D A TED ANN U AL R E P O R T.— (1) I N C LUSION IN ANNUAL DE F ENSE MANPO W ER RE Q UIRE- MENTS REPORT.—Section 115a of title 10, United States Code, is amended by inserting after subsection (e) the following new subsection: ‘‘(f) T he Secretary shall also include in each such report the following information with respect to personnel assigned to or sup- porting ma j or Department of Defense headquarters activities: ‘‘(1) The military end strength and civilian full-time equiva- lents assigned to major Department of Defense headquarters activities for the preceding fiscal year and estimates of such numbers for the current fiscal year and subsequent fiscal years. ‘‘(2) A summary of the replacement during the preceding fiscal year of contract workyears providing support to major Department of Defense headquarters activities with military end strength or civilian full-time equivalents, including an esti- mate of the number of contract workyears associated with the replacement of contracts performing inherently govern- mental or exempt functions. ‘‘(3) The plan for the continued review of contract personnel supporting major Department of Defense headquarters activi- ties for possible conversion to military or civilian performance in accordance with section 2463 of this title. ‘‘(4) The amount of any adjustment in the limitation on personnel made by the Secretary of Defense or the Secretary of a military department, and, for each adjustment made pursu- ant to section 1111(b)(2) of the Duncan Hunter National 10USC 1 43note.
