(d) C O NSI D E RA TION.—As consideration for the conveyance under subsection (a), the eligible entity shall provide the Air F orce w ith real property or real property improvements, or a combination of both, of e q ual value, as determined by the Secretary. I f the fair mar k et value of the real property or real property improve - ments, or combination thereof, is less than the fair market value of the real property to be conveyed by the Air Force, the eligible entity shall provide cash payment to the Air Force, or provide L ackland Air Force B ase with in-kind consideration of an amount equal to the difference in the fair market values. Any cash payment received by the Air Force for the conveyance authorized by sub- section (a) shall be deposited in the special account described in section 26 6 7 (e) of title 10 , U nited States Code, and shall be available to the Secretary for the same uses and sub j ect to the same limita- tions as provided in that section. (e) P A YM ENT O F COSTS OF CON V EYAN C E.— (1) IN GENERAL.—The Secretary may require the eligible entity to cover costs to be incurred by the Secretary, or to reimburse the Secretary for costs incurred by the Secretary, to carry out the conveyances under this section, including survey costs, costs related to environmental documentation, and other administrative costs related to the conveyances. If amounts are collected from the eligible entity in advance of the Secretary incurring the actual costs, and the amount col- lected exceeds the costs actually incurred by the Secretary to carry out the conveyance, the Secretary shall refund the excess amount to the eligible entity. (2) TREATMENT OF AMO U NTS RECEIVED.—Amounts received as reimbursement under paragraph (1) shall be credited to the fund or account that was used to cover the costs incurred by the Secretary in carrying out the conveyances. Amounts so credited shall be merged with amounts in such fund or account, and shall be available for the same purposes, and subject to the same conditions and limitations, as amounts in such fund or account. (f) SAVINGS PROVISION.— N othing in this section shall be con- strued to affect or limit the application of, or any obligation to comply with, any environmental law, including the National Environmental Policy Act ( 4 2 U.S.C. 4 3 21 et seq.), the Comprehen- sive Environmental R esponse, Compensation, and Liability Act of 1 98 0 (42 U.S.C. 9601 et seq.), and the Solid W aste D isposal Act (42 U.S.C. 6901 et seq.). (g) DESCRI P TION OF PROPERTY.—The exact acreage and legal description of the real property to be conveyed under subsection (a) shall be determined by a survey satisfactory to the Secretary. (h) ADDITIONAL TERMS AND CONDITIONS.—The Secretary may require such additional terms and conditions in connection with the conveyances under this section as the Secretary considers appro- priate to protect the interests of the United States.
