(a) PLAN . — The Secretary of Energy , in consultation w ith the D irector of National I ntelligence and the Secretary of Defense, shall p repare a plan to ensure that the national la b oratories over - seen by the Department of Energy maintain a robust technical capability to monitor, analy z e, and evaluate foreign nuclear weapons activities. (b) R EPORT .—Not later than F ebruary 2 8 ,2 01 0, the Secretary of Energy shall submit to the appropriate congressional committees a report describing the plan re q uired under subsection (a) and the resources necessary to implement the plan. The report shall be in unclassified form, but may include a classified anne x . (c) APPROPR I ATE CON G RE S SIONAL CO M MITTEES.—In this section, the term ‘ ‘appropriate congressional committees ’ ’ means— (1) the Committee on Armed Services, the Committee on Appropriations, and the Permanent Select Committee on Intel- ligence of the H ouse of Representatives

and (2) the Committee on Armed Services, the Committee on Appropriations, and the Select Committee on Intelligence of the Senate. SEC. 3133. COMPTROLLER GENERAL STUDY OF STOC K PILE STEWARD - S H IP PROGRAM. (a) IN G ENERAL.—The Comptroller General of the U nited States shall conduct a study of the stoc k pile stewardship program estab- lished under section 4 201 of the Atomic Energy Defense Act ( 5 0 U.S.C. 2521) to determine if the program was functioning, as of December 2008, as envisioned when the program was established. (b) ELEMENTS.—The study required by subsection (a) shall include the following

(1) An assessment of whether the capabilities determined to be necessary to maintain the nuclear weapons stockpile without the use of nuclear testing have been implemented and the extent to which such capabilities are functioning. (2) A review and description of the agreements governing use, management, and support of the capabilities developed for the stockpile stewardship program and an assessment of enforcement of, and compliance with, those agreements. ( 3 ) An assessment of plans for surveillance and testing of nuclear weapons in the stockpile and the extent of the compliance with such plans. (4) An assessment of— (A) the condition of the infrastructure at the plants and laboratories of the nuclear weapons complex; ( B ) the value of nuclear weapons facilities built after 1 9 92; (C) any plans that are in place to maintain, improve, or replace such infrastructure; (D) whether there is a validated requirement for all planned infrastructure replacement pro j ects; and (E) the projected costs for each such project and the time line for completion of each such project.
