( d )AS S I S TANCEFOR G U ATE M A L A. — ( 1 ) Of the funds a p propriated b y this Act under the heading ‘ ‘ I nternationa l Narcotics C ontrol and La wE nforcement ’ ’ not less than $4 , 0 00,000 shall be made available for a U nited States contribution to the International Commission Against Impunity in Guatemala (CICIG). ( 2 ) F unds appropriated by this Act under the heading ‘‘International M ilitary Education and Training’’ (IMET) that are available for assistance for Guatemala, other than for e x panded IMET, may be made available only for the Guate - malan Air Force, Navy and Army Corps of Engineers

d, That assistance for the Army Corps of Engineers shall only be available for training to improve disaster response capabili- ties and to participate in international peace k eeping operations: Provided fu r th er, That such funds may be made available only if the Secretary of State certifies that the Air Force, Navy and Army Corps of Engineers are respecting internationally recogni z ed human rights and cooperating with civilian j udicial investigations and prosecutions of current and retired military personnel who have been credibly alleged to have committed violations of such rights, and with the CICIG by granting access to CICIG personnel, providing evidence to CICIG, and allowing witness testimony. ( 3 ) Of the funds appropriated by this Act under the heading ‘‘Foreign Military Financing P rogram’’, not more than $1,000,000 may be made available for the Guatemalan Air Force, Navy and Army Corps of Engineers: Provided, That assistance for the Army Corps of Engineers shall only be avail- able for training to improve disaster response capabilities and to participate in international peacekeeping operations: Pro - vided further, That such funds may be made available only if the Secretary of State certifies that the Air Force, Navy and Army Corps of Engineers are respecting internationally recognized human rights and cooperating with civilian judicial investigations and prosecutions of current and retired military personnel who have been credibly alleged to have committed violations of such rights, including protecting and providing to the Attorney General’s office all military archives pertaining to the internal armed conflict, and cooperating with the CICIG by granting access to CICIG personnel, providing evidence to CICIG, and allowing witness testimony: Provided further, That funds made available in this Act for regional naval cooperation and maritime security assistance programs shall not be subject to the funding limitation of this subsection. (e) ASSISTANCE FOR ME X ICO.— (1) ASSISTANCE.—Of the funds appropriated under the headings ‘‘International Narcotics Control and Law Enforce- ment’’, ‘‘Foreign Military Financing Program’’, and ‘‘Economic Support Fund’’ in this Act, not more than $210,2 5 0,000 may be made available for assistance for Mexico, only to combat drug trafficking and related violence and organized crime, and for judicial reform, institution building, anti-corruption, and rule of law activities: Provided, That none of the funds made available under this subsection shall be made available for budget support or as cash payments.
