The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled ‘‘Budgetary Effects of PAYGO Legislation’’ for this Act, submitted for printing in the Congressional Record by the Chairman of the Committee on the Budget of the House of Representatives, as long as such statement has been submitted prior to the vote on passage of this Act. Subtitle B—Counter-Drug Activities SEC. 1011. UNIFIED COUNTER-DRUG AND COUNTERTERRORISM CAM- PAIGN IN COLOMBIA. Section 1021 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (Public Law 108–375; 118 Stat. 2042), as most recently amended by section 1011 of the National Defense Authorization Act for Fiscal Year 2010 (Public Law 111–84; 123 Stat. 2441), is further amended— (1) in subsection (a), by striking ‘‘2010’’ and inserting ‘‘2011’’; and (2) in subsection (c), by striking ‘‘2010’’ and inserting ‘‘2011’’. SEC. 1012. EXTENSION AND MODIFICATION OF JOINT TASK FORCES SUPPORT TO LAW ENFORCEMENT AGENCIES CON- DUCTING COUNTER-TERRORISM ACTIVITIES. (a) EXTENSION.—Subsection (b) of section 1022 of the National Defense Authorization Act for Fiscal Year 2004 (10 U.S.C. 371 note) is amended by striking ‘‘2010’’ and inserting ‘‘2011’’. (b) AVAILABILITY OF AUTHORITY.— (1) ADDITIONAL CONDITION ON AUTHORITY FOR SUPPORT AND ASSOCIATED WAIVER AUTHORITY.—Subsection (d) of such section is amended— (A) by inserting ‘‘(1)’’ before ‘‘Any support’’; and (B) by adding at the end the following new paragraph: ‘‘(2)(A) Support for counter-terrorism activities provided under subsection (a) may only be provided if the Secretary of Defense determines that the objectives of using the counter-drug funds of any joint task force to provide such support relate significantly to the objectives of providing support for counter-drug activities by that joint task force or any other joint task force. ‘‘(B) The Secretary of Defense may waive the requirements of subparagraph (A) if the Secretary determines that such a waiver is vital to the national security interests of the United States. The Secretary shall promptly submit to Congress notice in writing of any waiver issued under this subparagraph. ‘‘(C) The Secretary of Defense may delegate any responsibility of the Secretary under subparagraph (B) to the Deputy Secretary of Defense or to the Under Secretary of Defense for Policy. Except as provided in the preceding sentence, such a responsibility may not be delegated to any official of the Department of Defense or any other official.’’. Notice. Waiver authority.
